<br />,-;; <br />"./'~ <br /> <br />Interested persons are notified that the purpose of the Rules <br />and Regulations Concerning Cross-Connection and Backflow Control is <br />to eliminate or control existing cross-connections in order to <br />prevent the contamination or pollution of the Town's water system. <br />Such Rules and Regulations also require the installation, testing <br />and maintenance of backflow prevention devices by water customers <br />of the Town. Failure to comply with said Rules and Regulations <br />shall result in discontinuation of service. Specific requirements <br />are included for outdoor irrigation systems and fire systems. <br /> <br />4. As required by C.R.S. S3l-l6-204, the penalty clause <br />which appears in the Rules and Regulations of the Wiggins Water and <br />Sanitation District concerning Cross-Connection and Backflow <br />Control is set forth in full below and ordered published as part of <br />this adopting Ordinance: <br /> <br />UNLAWFUL ACT - PENALTY. C.R.S. S25-l-ll4(1) makes it <br />unlawful for any person, association or corporation, and the <br />officers thereof: <br /> <br />"(h) To make, install, maintain, or permit any cross- <br />connection between any water system supplying drinking <br />water to the public and any pipe, plumbing fixture, or <br />water system which contains water of a quality below the <br />minimum general sanitary standards as to the quality of <br />drinking water supplied to the public or to fail to <br />remove such connection within ten days after being <br />ordered in writing by the department to remove the same. <br />For the purposes of this paragraph (h), cross-connection <br />means any connection which would allow water to flow from <br />any pipe, plumbing fixture, or water system into a water <br />system supplying drinking water to the public." <br /> <br />C.R.S. S25-l-114(4) provides that any person who violates <br />this provision is guilty of a misdemeanor and, upon conviction <br />thereof, shall be punished by a fine of not more than one <br />thousand dollars, or by imprisonment in the county jail for <br />not more than one year, or by both such fine nd imprisonment <br />and, in addition to such fine and imprisonment, shall be <br />liable for any expense by health authorities in removing any <br />nuisance, source of filth, or cause of sickness. <br /> <br />INTRODUCED, READ AND APPROVED this 9th day of May, 1990. <br />Pursuant to C.R.S.
