<br />, <br />, <br /> <br />ARTICLE IV <br />EMFIllCEMENT OF CHARSES; CUST(JlER C(JlPLAINTS <br /> <br />Section 138. That the City Code of the City of Thornton, <br />Colorado, is hereby amended by the addition of Section 40-100 as <br />follows: <br /> <br />9 40-100 Lien for Unpaid Water/Sewer Charges <br /> <br />Regardless of the occupancy of a premises served by the Thornton <br />water and/or sewer system, the owner thereof shall be responsible for <br />the payment of all water and/or sewer service charges arising out of <br />provision of such service to the owner's premises or under any permit <br />issued to the ownerls premises. Such charges shall constitute a per- <br />petual and continuing lien upon the property until such charges have <br />been paid in full. No water/sewer service will be furnished to the <br />property. <br /> <br />Section 139. That the City Code of the City of Thornton, <br />Colorado, is hereby amended by the addition of Section 40-101 as <br />follows: <br /> <br />......, <br /> <br />9 40-101 Suspension of Revocation of Permit for Water/Sewer Service <br /> <br />Neither the granting of such pe.-it nor any act, circumstance or <br />condition shall operate to create any vested or proprietary right <br />whatsoever, but shall give the permittee the right to use water and/or <br />sewer service for the purposes specified in the permit, subject to <br />determination of such permit as herein provided. Every permit to use <br />water and/or sewer service shall be subject to revocat1on and Shutoff <br />by the Utilities Director without obligation upon the city to refund --. <br />or repay any consideration wh1ch may have been given for the granting <br />of such permit and without any obligation upon the city whatsoever for <br />anyone (1) or more of the following reasons: <br /> <br />A. Failure to comply with this Article or the applicable rules <br />and regulations of the Utilities Department. <br /> <br />B. Use of water/sewer system for purposes not authorized by a <br />permit. <br /> <br />C. <br /> <br />Non- a ent Involvin Two 2) or More Uses Fred One (1) Line <br />- n the case t a wo or more users are supp le w t <br />water from the same service line, If any of the parties fail <br />to pay the water service charges when due or fail to comply <br />with any rule of the Utilities Department, the Utilities <br />Department reserves the right to suspend the whole service <br />until such char~are paid or until the rules are strictI v <br />complied with. It is expressly stipulated that no claim for <br />damage or otherwise may be made against the City by any user <br />whose water charges have been paid or who has complied with <br />the rules and regulations of the Utilities Department <br />because of such turnoff, it being expressly stipulated that <br />the necessity for such turnoff shall be deemed to be the <br />joint act of all served through such service. <br /> <br />D. All other emergencies deemed necessary by the Utilities <br />Director. <br /> <br />iI <br /> <br />Section 140. That the City Code of the City of Thornton, <br />Colorado, is hereby amended by the addition of Section 40-102 as <br />follows: <br /> <br />9 40-102 Notice for Suspension of Service <br /> <br />Written notice of a proposed suspenSion of service shall be <br />mailed to the last known address of the customer as shown on the <br />Utilities Department's records. and a notice shall also be mailed to <br /> <br />-46- <br />
