<br />. ~ <br /> <br />r- <br /> <br />the property to which service Is being supplied or at which premises <br />the cause for suspension arose, If the property address differs from <br />the address to which billings are sent. Said notice shall Include the <br />following: <br /> <br />A. Notification that water service shall be suspended on the <br />date specified In the notice, which date shall be no sooner <br />than five (5) days after the date of mailing of the nottce. <br /> <br />8. The reason(s) for suspension of service. <br /> <br />C. An advisement to the owner or occupant that, If owner or <br />occupant does not believe reasonable cause exists for the <br />proposed suspension, owner or occupant may confer with a <br />Utilities Department representative prior to suspension. <br /> <br />D. The Utilities Division to be contacted to request a con- <br />ference Is Utilities Billing and Collections. <br /> <br />Section 141. That the City Code of the City of Thornton, <br />Colorado, Is hereby amended by the addition of Section 40-103 as <br />follows: <br /> <br />r- <br />I <br /> <br />~ 40-103 Suspension of Serylce <br /> <br />The owner or occupant may request, within five (5) days of <br />receiving a suspension notice, a conference with a Utilities <br />Department representative. If no conference is requested or payment <br />of delinquent charges has not been made or In the event that no <br />arrangement for such payment has been made or If the Utilities <br />Director finds that other reasonable cause still exists for suspension <br />prior to 5:00 p.m. on the date specified 1n the notice, water service <br />shall be suspended and shall not be reinstated until the cause for the <br />suspension has been cured. Prior to reinstatement of service to the <br />premises, all charges due, Including disconnection and reinstatement <br />charges, shall be paid In full. <br /> <br />Section 142. That the City Code of the City of Thornton, <br />Colorado, Is hereby amended by the addition of Section 40-104 as <br />follows: <br /> <br />~ 40-104 Appeals fro. Suspension Decisions <br /> <br />Any appeal from the decision of the Utilities Department repre- <br />sentative with respect to suspension of service shall be submitted In <br />writing to the Utilities Director within ten (10) days from the date <br />of the representative's decision. Such an appeal shall set forth, <br />with particularity, the groundS therefore. Notwithstanding such <br />appeal, service shall be or remain suspended unless the appeal Is <br />accompanied by payment of the amount in dispute or an amount deter- <br />mined as being sufficient to ensure continued compliance with all <br />..!I'l'1icable ordinances, rules and regUla~IO~, whlchamolJllt shall ~_____,___~_______.. <br />.------ specified In the designated representat ves's decision. The Utilities <br />Director shall review the proceedings before the designated represen- <br />tative and, within fifteen (15) days after receipt of the appeal, <br />shall enter a written ruling based thereon, a copy of which ruling <br />shall be sent by certified mail to the custOMer. In the event that <br />the decision Is adverse to the customer, all administrative recourse <br />In connection with the suspension of service shall be deemed to have <br />been exhausted, and the customer may thereupon pursue such further <br />remedy as is chosen by the customer. <br /> <br />Section 143.
