The likely final update <br /> in this case will occur at the next quarterly meeting. <br /> Paint Brush Hills Metropolitan District, Case No. 23GW06 <br /> Designated Basin: Upper Black Squirrel <br /> Management District: Upper Black Squirrel <br /> Attorneys: Christopher Davis <br /> Subject: Paint Brush Hills Metropolitan District ("Paint Brush ") has applied for a <br /> determination of right to an allocation of designated groundwater from the Denver <br /> aquifer underlying 480 acres. Paint Brush claims to have the consent of the owner <br /> of this land to withdraw the groundwater from this aquifer underlying this <br /> property. Additionally, in accordance with the Designated Basin Rule 11, the <br /> Colorado Ground Water Commission is considering a request by Paint Brush for a <br /> variance from Rule 5.3.7 for the application. Rule 5.3.7 states: "All wells, including <br /> Additional Wells, withdrawing designated ground water from the Denver Basin <br /> Aquifers, must be located on the overlying land." <br /> On February 23, 2023 and March 2, 2023, legal notice of the Applications was <br /> published in the Ranchland News newspaper. Upper Black Squirrel Creek GWMD and <br /> Lost Creek GWMD timely submitted an objection to the Application on the grounds <br /> that granting a variance from Rule 5.3.7 would sever the hydrologic impacts of the <br /> withdrawal of the allocation and injure senior water rights. <br /> Status: Paint Brush amended and re-published their application to allocate <br /> designated groundwater from the Denver aquifer for two consecutive weeks <br />
