At the last status conference on July 16, 2025, the <br /> Applicant indicated that they received comments from the opposers and were <br /> actively trying to address those concerns. The next status conference is set for <br /> October 7, 2025 to give the parties more time to discuss the language of Staff's <br /> proposed findings and orders and to address the opposers' concerns. <br /> Cherokee Metropolitan District, Case No. 24GW01 <br /> Designated Basin: Upper Black Squirrel Creek <br /> Management District: Upper Black Squirrel Creek <br /> Attorneys: John Newman <br /> Subject: Cherokee Metropolitan District applied for a change in type and place of <br /> use for well permit no. 11691-FP. Upper Black Squirrel Creek GWMD objected to the <br /> Application. <br /> Status: Staff resolved all remaining issues with the applicant and stipulated in <br /> this matter on October 9, 2024. The matter proceeded to hearing on October <br /> 24, 2024, to resolve the issue of whether or not the subject water right had in <br /> fact been abandoned prior to the application for a change in the water right. At <br /> the hearing, after the conclusion of evidence from the applicant and the lone <br /> remaining objector, and at the request of the participating parties, the hearing <br /> officer set a deadline for closing arguments in writing and for a determination <br /> on the question of abandonment and the change of the subject water right. The <br /> parties submitted their closing briefs on November 14, 2024. The hearing <br /> officer requested renewed access to the applicant's exhibits and received that <br /> access on April 15, 2025. The hearing officer granted Cherokee's application on <br /> June 9, 2025 and found that the objector had failed to prove abandonment of <br /> the water right being changed, resolving the remaining concern in this case.
