Jen Mele asked if timeline allows for expert reports or pre-hearing <br /> statements <br /> 1. Mr. Donegan responded that the timeline outlines the minimum <br /> timescale and that you can always hold hearings further out <br /> iii. Jen Mele presented the idea of having a hearing officer for the official <br /> rulemaking hearing <br /> 1. Board generally agreed that they are open to the use of a <br /> hearing officer <br /> 2. Kevin Donegan stated that DWR's Hearing Officer, Bryan Garrett, <br /> would potentially be available in May, 2025 for this hearing <br /> 3. Board agreed to further discuss availability for a hearing in May <br /> iv. Todd Hunter asked what the opposition to an increase in annular space is, <br /> noting the higher annulus used in surrounding states <br /> 1. Chris Sanchez stated that the main concern is the lack of <br /> definitive information regarding the need for an increase to the <br /> annular space requirement, advocating for more diligent <br /> collection of evidence and an increase in staffing of the Well <br /> Inspection Program <br /> 2. Jen Mele stated that the Board will have an opportunity to have <br /> a discussion and hear testimony regarding annular space during <br /> the rulemaking hearing <br /> v. Todd Hunter expressed concern over the entire Board's lack of discussion <br /> time and ability before the hearing due to the Open Meetings Law <br /> Break from 11:08 to 11:15 <br /> c. Public Comment <br /> i. Josh Weaver <br /> 1. Thanked staff for listening to contractors <br /> 2. Stated that contractors' fear rises from the perceived lack of <br /> facts used in the creation of the rules that will impact business <br /> ii. Mike Temple <br /> 1. Stated he had several comments on Rule 6.2.2 in the previous <br /> meeting, and asked if there were any change regarding those <br /> a. Mr. Jones stated that Staff has removed the requirement <br /> to notify the well owner <br /> b. Mr. Temple stated that his concern was actually regarding <br /> the increased reporting requirements <br /> ***striketl rough demotes Item was not discussed at this meeting <br />
