Harms Pit <br />Adequacy Letter <br />Page 2 of 4 <br />Exhibit C - Mining Plan (Rule 6.3.3) <br />6. Please state if the operation is intended to be an intermittent operation as defined in C.R.S. <br />34- 32.5- 103(11)(b). The Division considers an operation actively mining for at least one day <br />and year, but less than 180 days per year to be an intermittent operation. Active mining <br />operations require the development or extraction of a construction material from its <br />natural occurrences, which may include; open mining, surface operations, transportation <br />operations, processing operations such as crushing and sorting, as well as stockpile removal. <br />Please note regular onsite maintenance activities such as weed control, site maintenance, <br />and storm water control maintenance do not constitute mining activities. <br />A letter titled "Review of Current Permit Status Regarding Temporary Cessation" is attached <br />which further explains intermittent operation status and Temporary Cessation of mining <br />operations. <br />7. Please estimate the depth to which soil, suitable as a plant growth medium, will be salvaged <br />for use in the reclamation process. <br />8. The Applicant states any available topsoil removed before mining will be stockpiled directly <br />adjacent to the mined area to be replaced as topsoil in the reclamation process. Please verify <br />all topsoil and other stockpiles will be located within the proposed permit boundary. <br />9. The Applicant states the gravel operation will be dry, not intercept groundwater. Please note <br />the mining operation must stay a minimum of two (2) feet above the groundwater elevation <br />to be considered a "dry" operation. <br />10. Please state if the proposed reclamation slopes will be mined at the final 3H:1V grade or if <br />backfilling of a vertical highwall will be required to create the final slopes. <br />11. The Applicant states there is no issue of water rights related to this particular gravel permit. <br />Please commit to obtaining a Stormwater Management Plan permit from the Colorado <br />Department of Public Health and Environment for the proposed sand and gravel mining and <br />processing operation and update Exhibit F accordingly. <br />Exhibit D - Reclamation Plan (Rule 6.3.4) <br />12. Please state to what depth overburden will be replaced during reclamation. The Applicant <br />stated in the Mining Plan the overburden depth is from 6 to 12 inches in depth. The <br />Division recommends the Applicant commit to replacing 6 to 8 inches of overburden during <br />reclamation. <br />13. Please specify the maximum gradient of the reclaimed slopes during reclamation, not the <br />topsoil stockpiles. The Division recommends reclaimed slopes not steeper than 3H:1V. <br />
