Box 609 Director <br />Pine Bluffs, Wyoming 82042 <br />Re: Pine Bluffs Gravel & Excavating, Inc., Harms Pit, File No. M- 2013 -018 <br />110c Permit Application Adequacy Review <br />Dear Mr. Keller: <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of Pine <br />Bluffs Gravel & Excavating, Inc. 110c permit application for the Harms Pit, File No. M- 2013 -018, <br />and submits the following comments. The Division is required to make an approval or denial <br />decision no later than June 12, 2013 therefore; a response to the following adequacy review <br />concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.3 (3), please submit proof of publication in a newspaper of general <br />circulation in the locality of the proposed mining operation. <br />2. As required by Rule 1.6.2 (e), please submit proof of the notice to all owners of record of <br />surface and mineral rights of the affected land and the owners of record of all land surface <br />within 200 feet of the boundary of the affected land including all easement holders located <br />on the affected land and within 200 feet of the boundary of the affected land. Proof of <br />notice may be return receipts of a Certified Mailing or by proof of personal service. <br />3. The Division received comments from History Colorado and the Army Corps of Engineers. <br />The letters are attached for your review. Please address the comments noted in the letters <br />and make any changes in the application as necessary. <br />Exhibit A - Legal Description and Location Map (Rule 6.3.1): <br />4. The distance from the Section 34 bearing point defers between the metes and bounds legal <br />description (1395.64') and the metes and bounds survey map (1395.94'). Please review the <br />legal description and location map and revise the exhibit accordingly. <br />5. The metes and bounds descriptions defer between the legal description and the survey map <br />in the bearing direction of the description (i.e. thence S.000 00' 00 "W., a distance of 434.73 <br />feet in the description versus thence NO° 00' 00 "E, 434.73' on the map).
