110c Permit Application Adequacy Review
Dear Mr. Keller:
The Division of Reclamation, Mining and Safety (Division) has reviewed the content of Pine
Bluffs Gravel & Excavating, Inc. 110c permit application for the Harms Pit, File No. M- 2013 -018,
and submits the following comments. The Division is required to make an approval or denial
decision no later than June 12, 2013 therefore; a response to the following adequacy review
concerns should be submitted to the Division as soon as possible.
1. As required by Rule 1.6.3 (3), please submit proof of publication in a newspaper of general
circulation in the locality of the proposed mining operation.
2. As required by Rule 1.6.2 (e), please submit proof of the notice to all owners of record of
surface and mineral rights of the affected land and the owners of record of all land surface
within 200 feet of the boundary of the affected land including all easement holders located
on the affected land and within 200 feet of the boundary of the affected land. Proof of
notice may be return receipts of a Certified Mailing or by proof of personal service.
3. The Division received comments from History Colorado and the Army Corps of Engineers.
The letters are attached for your review. Please address the comments noted in the letters
and make any changes in the application as necessary.
Exhibit A - Legal Description and Location Map (Rule 6.3.1):
4. The distance from the Section 34 bearing point defers between the metes and bounds legal
description (1395.64') and the metes and bounds survey map (1395.94'). Please review the
legal description and location map and revise the exhibit accordingly.
5. The metes and bounds descriptions defer between the legal description and the survey map
in the bearing direction of the description (i.e. thence S.000 00' 00 "W., a distance of 434.73
feet in the description versus thence NO° 00' 00 "E, 434.73' on the map). Please explain this
discrepancy and revise the exhibit accordingly.
