Therefore the required mitigation for replacement of the trees and <br />The number of upland trees that were actually impacted was reduced from 10 trees as <br />permitted in the 2011 BA to an actual impact of 2 small trees which will be replaced following <br />Phase 1 construction activities. The number of upland shrubs that were actually impacted was <br />reduced from 86 upland shrubs in the 2011 BA to an actual impact of 37 upland shrubs. Due to <br />the need to replace shrubs at a 1:1.5 ratio, there will be 58 shrubs replaced in restored upland <br />areas following Phase 1 construction activities. There will be an additional 150 upland shrubs <br />installed in the 0.09 acre enhanced upland area as shown on Table 2 to mitigate for the 0.08 <br />acre of permanent upland impact. This will bring the total upland shrub planting following Phase <br />1 construction to 208 shrubs. <br />As shown on Table 3, riparian tree impact was reduced from 172 riparian trees to 131. Due to <br />the mitigation ratio and size of the trees, there will be 194 trees replaced of which 20 will be <br />replaced following Phase 1 construction activities. The remaining 174 riparian trees will be <br />replaced following Phase 3 clean -up activities. The reason for the delay in planting the riparian <br />trees until after Phase 3 clean -up activities are complete is the lack of room in the restored <br />riparian areas along the creek upstream of the cut -off wall. We do not want to plant riparian <br />trees downstream of the cut -off wall because it is unclear which areas may be impacted during <br />Phase 3 clean -up activities. Therefore, we are concentrating all Phase 1 mitigation efforts such <br />as tree and shrub planting upstream of the cut -off wall. <br />Schwartzwalder Mine Actual Area Impact Page 7 <br />January 2013 <br />
