January 28, 2013 C-1981-012/New Elk Mine LDS <br /> GENERAL MINE PLAN COMPLIANCE: <br /> The response to the mid-term permit review is pending. A number of inconsistencies will be addressed during this <br /> process. Some,but not all,are mentioned elsewhere in this report and the reports of October and January. <br /> h1 several locations culverts had been removed but not replaced. Mr Thompson, Mr Steele and Mr Wilson <br /> explained that NECC intends to use only 12 gauge culverts from now on (as opposed to the thinner 16 gauge)to <br /> reduce the frequency of damage to culverts and the costly maintenance that entails. The culvert supplier had <br /> mistakenly sent 16 gauge culverts which needed to be returned. This delayed the completion of several of the <br /> projects described under the HYDROLOGIC BALANCE section of this report. <br /> Currently there is no area identified for non-coal waste storage before disposal. Mr Thompson has stated <br /> previously that non-coal waste is currently collected in dumpsters and hauled off site. hi any case,trash should <br /> not be allowed to accumulate around the site. <br /> PROCESSING WASTE/COAL MINE WASTE PILES—Rule 4.10 and 4.11 <br /> Drainage Control; Surface Stabilization; Placement: <br /> The RDA appeared stable and well drained. Despite the snow,it was clear that the reclaimed lower slopes and <br /> benches were well vegetated. The piezometers on the RDA benches were checked and tagged by GPS. <br /> ROADS —Rule 4.03 <br /> Construction 4.03.1(3)/4.03.2(3),- Drainage 4.03.1(4)/4.03.2(4),- Surfacing and Maintenance4.03.1(5)and <br /> (6)/4.03.2(5) and(6); Reclamation 4.03.1(7)/4.03.2(7): <br /> All roads on the mine site were well drained and maintained. <br /> REVEGETATION—Rule 4.15 <br /> Vegetative Cover; Timing: <br /> The snow cover made any assessment of vegetative cover challenging. <br /> SUPPORT FACILITIES -Rule 4.04: <br /> The Jansen Load-out was inspected on Monday 28th. Weeds around the stockpile had been cleared. There was a <br /> little trash at the east end of the site and the berm was indistinct. Boundary markers were in place. The east sump <br /> had been cleared,but the west sump was overgrown to the point that it was difficult to identify. Materials left over <br /> by the railroad were scattered around the site. The mine ID sign had been updated by the end of the inspection. See <br /> photos 10-14. Trash should be cleared and the berm restored at the east end of the site; the west sump <br /> should be cleaned out; the railroad materials should be "organized" or removed. <br /> The Apache Canyon airshafts were inspected on Tuesday 29th. No recent disturbance was evident at either site. <br /> Mine ID signs were in place and had been updated by the end of the inspection. A small amount of sloughage had <br /> occurred under the concrete pad at the second airshaft(see photo 15). <br /> Sloughage around the pad at the second airshaft should be filled in. <br /> Offsite monitoring wells were inspected on Tuesday 28th. The following Hydrologic Monitoring Points were <br /> checked and tagged by GPS: NM-20,NM-21,NM-22,NM-23,NE-6-IOa,NE-6-IOb,NEW 3, SF-2.
