January 28, 2013 C-1981-012/New Elk Mine LDS <br /> • Downstream of C30, C26 was undersized (the permit specifies 60"diameter). It was also placed in such a <br /> way as to form an impoundment(see photo 6). C26 should be removed and replaced with a culvert of <br /> the appropriate diameter,with its base at the same level as the channel's thalweg.Alternatively, <br /> NECC may decide that it would be preferable,from a long term maintenance perspective,to remove the <br /> culvert entirely and restore an open channel; if so,NECC should inform the Division of such intent in <br /> writing and the redesign of the channel outlet can be addressed in conjunction with the mid-term review. <br /> • The section of concrete culvert in ditch D 14 adjacent to DWDA 2 and north of the river had been <br /> removed, and the design capacity of the ditch restored(see photo 7). The location of the water line valve <br /> underneath this ditch remains a matter of concern,however, since the line is not currently in use it is not <br /> an immediate problem. <br /> • The berm on the east side of containment 3 should be restored. <br /> • The silt fences at either end of the topsoil SAE should be re-keyed. <br /> South of the Purgatoire River: <br /> • The area around the Bates portals is currently being re-designed. Mr Thompson plans to allow run-off <br /> over the relatively small disturbed area sheet flow(or infiltrate)over a crushed rock surface towards the <br /> silos. This run-off will be collected into a culvert on the south of the road which will outlet on the north <br /> side of the road. All disturbed area run-off will therefore be conducted along the north side of the road,to <br /> pond 7. The Division will review the design when it is submitted as part of a technical revision. <br /> • The embankments and spillways of Pond 7 were in good order. Of the two culverts which outlet into pond <br /> 7, C32 looked clear but C20 appeared to be partially plugged(see photo 8). Access to the area was <br /> difficult and this could have been ice build-up,however NECC should check this culvert and clean if <br /> necessary. <br /> • The embankments of pond 6 appeared in good order. Pond 6 will be lined in the future to provide process <br /> water. There are no surface water structures running into pond 6. <br /> • Culvert C17B had been identified as blocked or damaged by Mr Wilson,and removed.NECC was waiting <br /> on new culverts to be delivered before it could be replaced(see photo 9). Culvert C17A provides access to <br /> the escape hatch,it was clear. C17 was clear at the inlet and outlet. C17C is shown in table 21,but no <br /> longer exists on the ground. C17B should be replaced and table 21 should be updated to reflect the <br /> removal of C17C as part of the technical revision in response to the mid-term review. <br /> • The culverts at the four-way intersection were as before. The outlet of culvert C9 should be cleared. <br /> • The flow path from ditch D 13 through to D 15 (and ultimately pond 7)had been temporarily restored by <br /> digging a ditch in front of the new pump-house. <br /> • On the opposite side of the road,the problems caused by the power pole and the difficult hydraulics <br /> through the C 16 system of culverts were still evident,however re-design of the surface water controls in <br /> this area are underway. Mr Thompson expects to conduct runoff from ditch D 16 through a new culvert <br /> west of the power pole,north under the road to ditch D 15. The Division will review the design when it is <br /> submitted as part of a technical revision. <br /> • The straw bales on the south bank of the river,under the RDA conveyor should be replaced. <br /> • The berm at the east end of the SAE south of pond 7 should be re-built. <br /> Number of Partial Inspection this Fiscal Year: 4 <br /> Number of Complete Inspections this Fiscal Year: 3 <br /> Page 5 of 13 <br />
