Letter to Bryce Romig 5 April 12, 2001
DRAFT
5. Eagle Valley Borrow Areas
The DMG, through approval of Revision SR-03 releases Climax from reclamation liability for grading
area C-14 illustrated on the permit amendment AM-02 map. The costs associated with this reclamation
task from the 1999 Climax estimate, in the amount of$2,517.00 are eliminated from the amount of
required bond as detailed below. Limitations to the release of reclamation responsibility for the grading
of area C-14 are as follows:
• On-going maintenance of storm water controls and repair of rills and gullies may be required in area
C-14.
• A small zone of black shale exposed in area C-14 may require placement of viable growth media to
establish adequate vegetation (see 9/26/00 inspection report).
• Revegetation responsibility release was not requested by Climax and is not included.
No. 7-Shaft Sealing
As discussed during the September 26, 2000 inspection, DMG will continue to hold the amount of bond
dedicated to the 7-Shaft sealing project until the needed documentation for the 7-Shaft seal discussed
and described in the inspection report is provided.
6. Buildings Demolition
The DMG, through approval of Revision SR-03 releases Climax from reclamation liability for
demolition and disposal of the Precon Building and No. 3-Thickner superstructures. The costs
associated with these demolition tasks, in the amount of$79,437 have been eliminated from the
required bond as detailed below. Limitations to the release of reclamation responsibility for the
demolition of these structures are as follows:
• Fine grained, potentially acid generating residue (concentrates) at the No. 3-Thickner site may
require relocation to the tailing ponds or other suitable disposal site.
• The Precon Building and No. 3-Thickner foundations may require rubblization and backfilling or
covering for final reclamation.
• Revegetation responsibility release was not requested by Climax and is not included.
Summary—Net Result of the Approval of Revision SR-03 on the Bond
The Climax surety reduction request included with the SR-03 application totals $3,946,942.00.
However, certain adjustments to this amount are necessary as reflected in the remarks above. Through
approval of revision SR-03, DMG calculates the current appropriate bond amount reduction as follows:
