Letter to Bryce Romig 4 April 12, 2001 <br /> DRAFT <br /> approval of SR-03 as detailed below. Limitations to the release of reclamation responsibility for the 3- <br /> Dam capping project are as follows: <br /> • On-going maintenance of storm water controls and repair of rills and gullies may be required on 3- <br /> Dam (see 9/26/00 inspection report). <br /> • Revegetation responsibility release was not requested by Climax and is not included. <br /> • Area C-19 illustrated on the permit amendment AM-02 map is not released (see 9/26/00 inspection <br /> report). <br /> Mayflower Tailings Area <br /> The DMG, through approval of Revision SR-03 releases Climax from reclamation liability for capping <br /> a portion of the Mayflower Tailings Area. Capping of all but approximately 218 acres of the <br /> Mayflower Tailings Area was completed in 1990. The remaining 218 acres is the water pool area of the <br /> Mayflower Pond currently used for water treatment. Capping costs for the Mayflower Tailings outside <br /> the water pool area were not included in the DMG's 1998 cost estimate and were not included in the <br /> Climax 1999 estimate that forms the basis for the current secured bond amount (see attached memo <br /> dated April 10, 2000). As a result, release of bond monies for the completion of Mayflower beach rock <br /> and soil cap installation is not applicable to the approval of Revision SR-03. A slight adjustment to the <br /> Mayflower tailing geogrid acreage, reflecting the updated estimate of 218 acres of water pool area, will <br /> be included in the pending financial warranty review process. Limitations to the release of reclamation <br /> responsibility for the Mayflower beach capping project are as follows: <br /> • Revegetation responsibility release was not requested by Climax and is not included. <br /> • Area C-19 illustrated on the permit amendment AM-02 map is not released (see 9/26/00 inspection <br /> report). <br /> • The Mayflower borrow area east of the tailing impoundment is not released (see 9/26/00 inspection <br /> report). <br /> 4. Robinson Tailings Area <br /> The DMG, through approval of Revision SR-03 releases Climax from reclamation liability for capping <br /> a portion of the Robinson Tailings Area. Capping of all but approximately 219 acres of the Robinson <br /> water pool was completed in 1994. DMG approves the reduction in bond amount of$1,734,094 <br /> requested in the SR-03 application. The total bond amount required as a result of the approval of SR-03 <br /> will reflect this reduction as detailed below. The only limitation to the Robinson capping project <br /> release is that revegetation responsibility release was not requested by Climax and is not included. The <br /> pending financial warranty review process will re-estimate and update reclamation capping costs for <br /> Robinson tailings based on the 219 remaining acres, the requirements of the reclamation plan, and the <br /> assumption that geogrid installation will be required to support the capping material. <br />
