Letter to BUce Romig 3 April 12, 2001 <br /> DRAFT <br /> River channel, including cut and fill balances and channel configuration details, may be required as a <br /> technical revision to the permit as a result of the observations made during the pending inspection. <br /> DMG currently holds $292,930.00 in bond for the backfilling and grading of Storke Yard and <br /> reconstruction of the Arkansas River channel (see sections 4.1 and 4.15 of the February 1999 Climax <br /> estimate). The SR-03 application requests Bond reduction in the amount of$155,381.00 for the <br /> reclamation completed to date in the Storke Yard. DMG's estimated costs for the completion of <br /> reclamation earthwork in the Storke Yard, assuming that the Arkansas River cut material can be <br /> blended and backfilled adjacent to the channel, is $175,543.00 (see inspection report dated September <br /> 26, 2000 and attachments). The DMG estimate yields a bond reduction of$292,930.00 - $175,543.00 = <br /> $117,387.00 for the Storke Yard. The total bond amount required as a result of the approval of SR-03 <br /> will reflect this reduction as detailed below. <br /> 2. E-Dump <br /> The DMG, through approval of Revision SR-03 releases Climax from reclamation liability for grading <br /> the west side of E-Dump. The bond amount of$409,165.00 dedicated to this grading project based on <br /> the February 1999 Climax estimate is subtracted from the total bond amount required as a result of the <br /> approval of SR-03 as detailed below. Climax requested further reduction in bonding for E-Dump to <br /> reflect extensive topsoil placement completed on E- Dump in conjunction with the Eagle Park <br /> Reservoir Project. DMG currently holds $12,124.00 bond for E-Dump topsoiling (section 4.4, 1999 <br /> Climax estimate), and has determined that this topsoiling bond should remain in place even though <br /> extensive topsoil placement above and beyond reclamation permit requirements has already occurred on <br /> the dump's west side. The E-Dump topsoiling cost is not deleted from the amount of required bond <br /> because the topsoil that this cost applies to remains in stockpile, and if it is not spread on E-Dump it <br /> will be used to enhance revegetation potential elsewhere on the affected land. Removing the E-Dump <br /> topsoiling cost from the bond could compromise the assurance that all of the topsoil stockpiled for <br /> reclamation at Climax could be put to beneficial use. Limitations to the release of reclamation <br /> responsibility for the west side of E-Dump are as follows: <br /> • Topsoiling requirement remains in place as discussed above. <br /> • On-going maintenance of storm water controls, repair of rills and gullies, and improvements to <br /> manage potentially acidic seepage may be required on E-Dump (see 9/26/00 and 8/30/99 inspection <br /> reports). <br /> • Revegetation responsibility release was not requested by Climax and is not included. <br /> 3. No. 3-Dam <br /> The DMG, through approval of Revision SR-03 releases Climax from reclamation liability for grading <br /> and capping No. 3-Dam. The bond amount of$735,691.00 dedicated to this grading project based on <br /> the February 1999 Climax estimate is subtracted from the total bond amount required as a result of the <br />
