WE ARE NOT GOING TO ACCEPT THIS AND WE WILL NOT <br />ALLOW FOR TI-HS TO HAPPEN 11111 AND VVE ARE DEMANDING THAT IF NRCS IS <br />INCLUDED WHICH THEY HAVEN'T BEEN IN THIS REVISION, THAT IS REQUIRED, <br />THAT WE BE INCLUDED IN ANY AND ALL CONVERSTIONS, VERBAL, WRITTEN, <br />OR IN PERSON. WE DEMANDING TO BE PRESENT AND DEMANDING TO BE IN <br />ANY CONVERSATIONS REGARDING OUR PROPERTY THAT INVOLVES NRCSU! <br />NRCS WAS NOT CONSULTED ON THIS AND THEY WILL BE GIVEN ALL THE <br />FACTS FROM US AND WE ARE NOT BEING LEFT OUT THIS TIME!!! They will be <br />given the facts and not a bunch of lies as they have been already told 1 am sending <br />NRCS a copy of the rules as well as a copy of the Judgment which the Judge ruled that <br />they not only breached the lease, but broke the rules and regulations and it was WFC's <br />duty to make sure the STATE had the correct information. They are also in default on <br />the lease and the breaking of the rules was sent to them years ago and they had 30 <br />days to correct the default and they did not. The Judge confirmed this breach. None <br />of our soils were suppose to leave this place and they had to do a prime farmland <br />investigation. As far as we are concerned, if this incompetent, ridiculous, revision <br />continues, that contract is null and void and we will do anything and everything <br />necessary to make sure our property is put back 'as good as or better" to equivalent <br />uses or higher uses that it had prior to mining. But along the way, some how, we are <br />going to get this message to anyone and everyone in the country about what WFC and <br />the State is allowing to happen to this place. And if it was OSM intention to try and <br />change our prime farmland status as Dejoia states, then shame on you. And if anyone <br />really believes that WFC only salvaged 22 inches as Dejoia states, then we have a real <br />problem. This is not the information that we were provided prior to this sampling and <br />TR -61 was to take samples only and if this technical revision was used for any other <br />purpose, then the rules and regulations have been violated again regarding the <br />definition of a technical revision. And if Dejoia was given this information, then we again <br />had our land owner rights violated and were not included in these discussions and <br />again the rules and regulations were violated. Federal and State laws were violated. <br />We had 196,358 cubic yards of prime soils stolen from us by WFC and I don't care what <br />WFC wants you to believe, we are requesting an informal hearing here and the <br />ranchers and farmers here will tell you differently. I also am requesting that NRCS be <br />present here for this hearing, since it's not in court, and it's not a civil matter, and they <br />were permitted to come to the first informal hearing, and we are requesting that you <br />require them to be here.
