JoEllen Turner <br />970 - 864 -7682 p.6 <br />First off: Appropriate standards were suppose to be enforced to minimize damage to <br />the environment and the productivity of the soils. The primary governmental <br />responsibility for developing, authorizing, issuing, and enforcing regulations for the <br />surface mining and reclamation operations subject to the ACT is the States <br />responsibility. They are to assure the rights of surface land owners and other persons <br />with a legal interest in the land are fully protected from mining operations. Make sure <br />that the mining operations protect the environment. This farm and these soils are our <br />environment. Anything around us is our environment. Of, course, all the environmental <br />specialist should know that. It's not designed to protect the mines wealth and jobs, its <br />designed to protect the land owner. <br />It assures us that adequate procedures will be taken to reclaim the surface area as <br />contemporaneously as possible. Remember, we have only been stockpiled for just 10 <br />years. Considering that while I worked for WFC, we had each piece of mined property <br />returned into production in 2 years and the farmer was getting his production 2 years <br />after it was mined. We have piles of soils. <br />To work hand in hand to provide the Nations energy and have our environment and <br />productivity of the property restored. Mr. Morgan leased to give them the coal they <br />needed and since that time, we have had nothing but headaches and heartaches. AND <br />none of this place has ever been put back into production in 10 years. They were <br />suppose to remove the soils, take the coal, put our soils back and no soils were to be <br />stolen from this place and were to go back on this place(lease agreement that was <br />breached) and prime farmland rules. <br />Wherever necessary, EXERCISE the full reach of the FEDERAL constitutional powers <br />to insure the protection of the public interest through effective control of surface coal <br />mining operations. This gives us the right to seek Office of Surface Mining for help. <br />OSM's duties: administer the programs for controlling surface coal mining which are <br />required by the ACT. Review and approve or disapprove STATE programs for <br />controlling surface mining operations and reclaiming mined lands. Make those <br />investigations and inspections necessary to INSURE compliance with this ACT. <br />Conduct hearings, administer oaths, issue subpoenas, and compel witnesses and <br />production of written or printed materials as provided for in this ACT. Issue cease and <br />desist orders, and order the SUSPENSION,REVOCATION, OR WITHHOLDING OF <br />ANY PERMIT FOR FAILURE TO COMPLY WITH ANY PROVISION OF THIS ACT OR <br />ANY RULES AND REGULATIONS ADOPTED PURSUANT THERETO. Why are you <br />allowing this? Why are you even allowing a permit renewal which we have objected to. <br />They are not in compliance with the Act nor is this permit revision. It is a complete <br />violation of every rule, regulation, and the ACT. They have a JUDGE that has stated <br />that they have violated the rules and regulations and the ACT. They have breached <br />our lease and they are still not in compliance with the rules and regulations. We do not <br />them here anymore. They need to restore to as good as or better than it was. This <br />property has already been damaged and what they are proposing damages it even <br />further. They have violated a DIRECT BOARD ORDER, and they have violated the <br />procedures for obtaining a new revision. The other one is still under appeal and a new <br />permit can't be issued without our informal hearing which will lead to a formal hearing <br />and back to court because we are not going to allow this. Pr -06 has not yet been heard <br />in court. They BRAGGED ON THE WINNING OF PR -06, publicizing their victory in the <br />49 12 ape <br />
