Our soils were Barx 2E soils and these soils have been documented for <br />many many years, and no hired gun is going to come in here 10 years later of us living <br />pure hell and 'ASSUME AND WE BELIEVE" THIS IS HOW IT WAS AND THEN TAKE <br />AN ERRONEOUS PR -06 ORIGINAL DOCUMENT AND COPY IT. You may also being <br />receiving some kind of suit from other sources stating that the CCC ditch is <br />" INEEFICIENT'. And all the corrections and adequacy reviews that you can conceive <br />will not change that this permit revision is entirely illegal. Please send me a copy of all <br />the Colorado State rules and regulations and the part of the ACT that allows you to do <br />this because it is obviously clear that I must have the wrong set. I have the set that we <br />are suppose to see and obviously you have a new set and I am requesting a copy of <br />those immediately. You may email them to me, you have my email. The State needs to <br />read their job descriptions and why you even have a job because allowing this totally <br />ridiculous revision also violates all your requirements. <br />Dear OSM: This is a formal complaint against the State and WFC. The State is not <br />maintaining and enforcing the rules and regulations that we were ordered to follow. We <br />had to follow all proper procedures on from filing objections, to informal hearing, to <br />administrative review, to formal hearings, to District court for judicial review, <br />administrative help as well as OSM help. The Judge has not even ruled on Pr -06 which <br />it has been over 2 years and we haven't even been heard. All the things required were <br />abided to by us. Not WFC, but by us. The State needed to banish this revision <br />immediately because it went in the backdoor and is trying to overturn a Board decision <br />without having to appeal a decision and without anything_ This is totally illegal, not only <br />against State rules and the Act, against Federal requirements, and also Colorado <br />Statues. We need the proper paperwork so that we can get this all completed. And <br />know the proper procedures since it's only the landowner that is having to abide by any <br />rules here. We need to know how to file all these complaints against the State and <br />WFC for what they are doing. Our property has all been mined and the backfilling is <br />almost complete and our property. We need our property restored to the conditions it <br />was prior to mining, to AS good as or Better to the Uses or higher uses than it had. And <br />the proper irragation needs to be restored and not the labor intensive irrigation they are <br />suggesting which will never be possible. They have actually changed this to worse, not <br />better with this permit revision. This is a complaint that the State is allowing a revision <br />that is illegal., that doesn't comply with rules and regulations, and that is allowing a <br />Board decision to be reversed to a worse case scenario, DICTATES a step by step <br />procedure of irrigating, and by the way, water doesn't run up hill, and the hours and <br />hours of shoveling was left out, and 24 hour sets will never happen here because alfalfa <br />will drownand when it's dead, it's dead. They have us with some type of baler that we <br />don't even own, and other wrong equipment with their expert knowledge and <br />experience, I presume. They have put down the wrong soil types documented by <br />NRCS for over 40 years, and the CCC ditch as be INEFFICIENT" irrigation system and <br />claiming it in itself is not adequate, they have us with Quotas and reports from <br />Mr.Morgan and SCS that are very much lies, they have us with a harrow to help level, I <br />suppose their cheese slid off their cracker here, how ridiculous. They have us with <br />ROCKS as not being critical in our farming and with a ripper going 18 inches and our <br />ripper goes 30 inches, but they didn't give us enough topsoil to go 30 inches, and this is <br />47IPage <br />JoEllen Turner <br />970 - 864 -7682 p.4 <br />
