It's pretty obvious that the State <br />doesn't have any intentions of doing their jobs or they would not have allowed such a <br />ridiculous revision that sent all the progress right straight back to 5 years ago. Mr. Berry <br />ordered these things to be worked out and most things had already been done until this <br />revision that degressed to the things that we started with 5 years ago. Mr. Dejoia and <br />lewicki, you need to get your facts straight and forget all this crap you produce because <br />you have a fight now a real fight. We seen some progress over the past 5 years and <br />finally got some of your lies and facts put to real use, but now, you have shown us that <br />you have NO NO intentions of fixing this place and this isn't going to happen and if the <br />State won't do something to fix this, then we will. <br />We want an informal hearing here, taped. And I am requesting a copy of the tape, not a <br />transcript and I also will be taping it as well as othersw We will try and get in touch with <br />the television stations and news media, as well as the Sheep Mountain alliance which is <br />an environmentalist group that fights coal mines and the things they do to people. <br />People with some money that can help us fight this. We had a beautiful effficient, <br />working ranch here and no WFC, State, or government agency is going to take that <br />away from us. I will try and contact all the Board members directly. We have a Board <br />order which the proper procedure that we had to follow was to appeal that if you <br />believed that it was not in compliance. These rules and regulations are written for the <br />Mine not for the landowner, but we followed all the rules and regulations governing <br />surface coal mining and we appealed costing us thousands and thousands of dollars <br />doing THE OUR TO MAKES RE THAT THE STATE OR WESTERN FUELS WAS NOT T OUR JOBS S LS DO <br />THEIR JOBS. <br />This is also a formal complaint to the Office of Surface Mining. The State is not <br />enforcing the rules and regulations and they are not in compliance with what the rules <br />and regulations that state they must be. We are requesting administrative procedures <br />and we are requesting an informal review and this means communicating with the <br />Landowner. Since the civil suit began, DRMS, OSM, and other agencies refuse to <br />communicate with us. We have sent hundreds of objections an are requesting an <br />informal hearing to be held here in Nucla Colorado at a neutral place and convenient <br />time that all these farmers and ranchers may attend. This revision is illegal and these <br />people around here need to know and see what WFC does and what the state allows. <br />They need to see that there is really no rules or regulations protecting them and that <br />these rules and regulations can be changed at will to suit the coal mine. They also need <br />to see how many thousands of dollars that we have spent because the State will not do <br />their jobs. The Board ordered that these things be done and the State will not even <br />carry out proper procedures to make sure they are done. Western Fuels never received <br />any type of punishment for stealing 196,000 cubic yards of our topsoil, they never got <br />punished for not segregating our soil, they never got punished for contamination, they <br />never got punished for anything that will ruin us for the rest of our lives. And all of this <br />was in the jurisdiction of the State. And this pr -07 simply went back to the VERY first <br />Pr -06 and copied it word for ward. Mr. Berry promised us, on tape, that he would try <br />and fix this. He promised on tape that this type of thing WOULD NEVER NEVER <br />25 'Page <br />
