6.5 GEOTECHNICAL STABILITY EXHIBIT <br />The Division's Review of Slope Stability Analysis memo is attached for reference. <br />Page 2 of 3 <br />Bucklen Equipment Company Pit <br />TR -01 Second Adequacy Review <br />Question #4 from August 28, 2012 <br />The Division file indicates the following structure agreements with the surrounding landowners <br />were submitted in 1992 as part of the amendment application process; Abstar Diengdoh, Ralph <br />A. Cowan and Phillip J. Kizer. The Division does not have a record of a structure agreement with <br />the City of Greeley for their properties and structures, including N 17th and N 21 Avenues, <br />within 200 feet of the affected land. Additionally, it appears the property owned by Phillip J. <br />Kizer is now owned by Pedro R. and Inez Gutierrez. Please submit revised structure agreements <br />as required by Rule 6.4.19, due to the change in the mining and reclamation plans. <br />1. In response to Question #4, the Operator submitted structure agreements with the surrounding <br />landowners, but did not provided a structure agreement with the City of Greeley for N 17 and <br />N 21 Avenues. The cross section located in the southwest corner of the current mined slope <br />has been identified as the critical section for the stability analysis; based on the Division's <br />stability analysis this section does not meet the Division's requirement for factor of safety. <br />Please submit a signed structure agreement for the roads owned by the City of Greeley or <br />address the problems as required by Question #2 below. <br />2. The Division of Reclamation, Mining and Safety (DRMS) reviewed the Slope Stability <br />Calculations memorandum dated November 29, 2012 for the Bucklen Equipment Company Pit <br />Area A prepared by Applegate Group, Inc. The eastern edge of N 21 Avenue is located <br />approximately 20 feet from the top of the mined pit slope and was identified by Applegate as <br />the critical section for the stability analysis. <br />Based on the Division's stability analysis this critical section in the mined state it is not stable <br />and must be addressed by the Operator, by either: <br />a. obtaining a structure agreement with the City of Greeley for N 21 Avenue <br />b. providing site specific soils properties for a more accurate stability analysis <br />c. backfill the area to address the stability concerns <br />3. The Applegate report states the soil parameters used for the analysis were based on values <br />used in the past for slope stability calculations and guidelines in the USBR publication "Design <br />of Small Dams ". The soil parameters used by Applegate in the stability analysis differ <br />considerably from the DRMS requirements for temporary pit slopes and the DRMS accepted <br />geotechnical standards. A copy of the DRMS requirements and standard soil properties for <br />stability analyses when no laboratory strength tests were performed on the on -site soils is <br />attached for reference. Please review the Division's requirements and standard soil properties <br />and either provide justification for the USBR soil parameters or re- analyze the slope stability <br />calculations utilizing the Division's standard soil properties. <br />
