Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of the response <br />to Technical Revision No. 1 Adequacy review letter dated December 18, 2012 for the Bucklen <br />Equipment Company Pit, File No. M- 1982 -131 and submits the following comments. <br />• Questions #1 -3 from the Division's Adequacy Letter dated August 28, 2012 were answered <br />satisfactorily by the Applicant in the response. <br />a. provide a notarized agreement between the applicant and the person(s) having an <br />interest in the structure, that the applicant is to provide compensation for any <br />damage to the structure; or <br />b. where such an agreement cannot be reached, the applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall not <br />be damaged by activities occurring at the mining operation; or. <br />Office of Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
