December 12,2012 C-2010-089/New Horizon North Mine MLT <br /> FISH and WILDLIFE—Rule 4.18: <br /> • A pair of bald eagles was sighted in the area. They were initially perched in the cottonwood <br /> trees next to the former alignment of the CCC West Lateral Ditch, where it crosses the <br /> Garvey property. The eagles flew off as we approached the area. <br /> • Deer and elk prints were observed within the disturbed area. <br /> • Mr. Ragsdale said he had seen a badger recently near culvert C-I on the permit's eastern <br /> boundary. <br /> HYDROLOGIC BALANCE - Rule 4.05 <br /> Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures <br /> 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; <br /> Surface Water Monitoring 4.05.13; Drainage—Acid and Toxic Materials 4.05.8; Impoundments <br /> 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br /> • Construction of Pond NHN-001 has been completed, together with the ditches (Photos 1 and <br /> 2) that flow into the pond from the east (NHN-001 East) and west (NHN-001 West). The as- <br /> built certification for the pond was submitted with the application for MR-02 and is being <br /> reviewed by the Division. <br /> • The approved design for Pond NHN-001 is found in the permit as Appendix 2.05.3(4)-1 and <br /> illustrated on Map 2.05.3(4)-I Surface Hydrology. A number of field modifications were <br /> made to the design. <br /> • Excavation of the western end of the pond was shallower than anticipated, due to the <br /> presence of a resistant sandstone ledge that would have required blasting (Photo 3). <br /> • The primary spillway, which consists of a riser with two 6" gated valves (Photo 4), was <br /> shifted westward to line up with the in-place 24" culvert passing beneath AA Road. <br /> • The emergency spillway was also shifted to allow flow to access another 24" culvert beneath <br /> AA Road, and a cylindrical concrete drop structure was installed to direct flow from the open <br /> channel into the exposed culvert end, below (Photos 5 and 6). <br /> • Ditches were revised significantly from the original design; A V-bottom shape replaces the <br /> original flat-bottom cross section, and reaches steeper that 2%have been lined with crushed <br /> rock, which is underlain by a layer of geotextile held in place by a geotextile of cellular form <br /> (Photos 7 and 8). <br /> OTHER(SPECIFY): <br /> • As a condition of the Special Use Permit from Montrose County, Western Fuels was required <br /> to upgrade the 2700 Road bridge across Tuttle Draw. County forces participated in the <br /> project, and installation of the new structure is now complete. The structure consists of <br /> prefabricated concrete sections, with upstream and downstream concrete wingwalls (Photo <br /> 9). The channel upstream, downstream and beneath the structure has been lined with large <br /> sandstone riprap. Traffic has been restored to the original alignment, but the driving surface <br /> has not yet been paved with asphalt. Permanent guard rail has not yet been installed,but <br /> temporary concrete barriers have been placed along the edge, for safety.
