( f)--Thus , the final resolution of NOV No. 79-V-5-24 was as <br /> r follows : <br /> 1 . Affirmed; abated by "acreage trade" technical re- <br /> vision; no civil penalty. <br /> 2 . Vacated. <br /> 3 . Affirmed; abated by clearing the culvert and rip- <br /> rapping inlet and outlet; civil penalty of $600 . <br /> Notice of Violation No. 80-5-7-11 <br /> (a )--Notice of Violation No. 80-5-7-11, containing one <br /> alleged violation of OSM' s interim regulations, was issued <br /> by OSM on April 8, 1980 . <br /> (b) and (e)--The NOV alleged failure to dispose of trash in <br /> accordance with state laws and regulations, in essence . <br /> CF&I abated the alleged violation by placing the trash in <br /> containers which had been ordered, but not received, prior <br /> to issuance of the NOV, and then regrading and reseeding <br /> the site. <br /> (c) , (d) and ( f)--On September 8, 1980 CF&I initiated an <br /> administrative proceeding, which was assigned Docket <br /> No. DV 0-26-P, before the Office of Hearings and Appeals of <br /> the U .S . Department of the Interior, located in Arlington, <br /> Virginia, contesting both the validity of the alleged vio- <br /> lation and the civil penalty of t2 , 400 proposed by OSM. <br /> That proceeding is still pending and, therefore, there has <br /> been no final resolution to this NOV as yet . <br /> Notice of Violation No. 80-5-5-8 <br /> (a)--Notice of Violation No . 80-5-5-8, containing one <br /> alleged violation of OSM' s interim regulations, was issued <br /> by OSM on August 12, 1980 . <br /> (b) , (e) and ( f)--The one violation alleged disposal of mine <br /> waste in an area not approved by the regulatory authority. <br /> Shortly thereafter, CF&I demonstrated to OSM that the loca- <br /> tion of the subject waste was an approved waste disposal <br /> site . Therefore, the alleged violation was vacated by OSM <br /> on August 20, 1980 .
