2. 03. 6--Right of Entry and Operation Information <br /> (1) CF&I bases its legal rights to enter and continue <br /> coal mining operations, which are not subject to <br /> any pending litigation, within the proposed permit <br /> area on the deeds and leases which are listed on <br /> the immediately following pages. The specific <br /> lands and coal to which these documents pertain <br /> and the interests owned by CF&I are listed. These <br /> documents give CF&I full ownership or a leasehold <br /> interest in all coal (and thereby the right to <br /> mine it) in the proposed mine plan area and full <br /> ownership of the surface to be affected by surface <br /> operations and facilities incidental thereto. The <br /> only exceptions to CF&I' s right to enter concerns <br /> the coal that is below parcels 12 and 69 in Section <br /> 19 and parcel 93 (Tract 5) in Section 29 . CF&I is <br /> seeking to purchase or lease these coal interests. <br /> If acquisition is not completed prior to final <br /> action on the application, CF&I requests that <br /> MLR approval to mine this coal be conditioned upon <br /> acquisition of the right to do so from the present <br /> owners. <br /> E <br /> (2) Not applicable, <br /> �f (3) Nothing required. <br /> 2.03 13 <br />
