3 . Affirmed; abated by implementation of an approved <br /> surface water monitoring plan; no civil penalty. <br /> 4 . To be affirmed or vacated depending upon MLR' s <br /> determination of whether ground water monitoring <br /> is required under interim regulations ; no civil <br /> penalty regardless of that determination. <br /> 5 . Affirmed; abated by removal of waste material <br /> from unapproved area; no civil penalty. <br /> 6 . Vacated . <br /> 7 . Vacated . <br /> Notice of Violation No. 79-V-5-24 <br /> (a) --Notice of. Violation No. 79-V-5-24, containing three <br /> alleged violations of OSM ' s interim regulations , was issued <br /> by OSM on August 3 , 1979 . <br /> (b) and (e ) --The nature of the violations alleged and the <br /> actions taken to abate them were as follows : <br /> 1 . Holding pond for mine water supply was located <br /> outside the permit area . The alleged violation <br /> was abated by CF&I ' s submission, and MLR' s ap- <br /> proval , of an "acreage trade" technical revision <br /> by which the holding pond was included within the <br /> permit area . <br /> 2 . Failure to remove or segregate, stockpile or pro- <br /> tect topsoil or selected overburden material . <br /> The alleged violation was vacated by OSM on De- <br /> cember 13 , 1979, upon OSM' s technical determina- <br /> tion that CF&I ' s handling of the topsoil was in <br /> accordance with the interim regulations . <br /> 3 . Failure to maintain and/or construct a culvert to <br /> avoid plugging and erosion at inlet and outlet . <br /> CF&I abated the alleged violation by clearing the <br /> culvert and by riprapping the inlet and outlet . <br /> (c) and (d ) --On February 11 , 1980, CF&I initiated an ad- <br /> ministrative proceeding , which was assigned Docket <br /> No. DV 0-4-P, before the Office of Hearings and Appeals of <br /> the U .S . Department of the Interior , located in Arlington, <br /> Virigina, to contest the validity of alleged violation <br /> No. 3 and the civil penalty of $1, 300 proposed by OSM with <br /> respect to it . That proceeding was dismissed by order of <br /> the OHA on May 13, 1980, based upon a settlement agreement <br /> pursuant to which the civil penaltv was reduced to $600 . <br /> 2.03-11 <br />
