Maxwell Mine <br /> File No. C-013-81 <br /> RESPONSE TO DRAFT FINDINGS DOCUMENT <br /> XVII B ackfilling and Grading - Rules 2 .05 .3(b) , 2 .05 .3(9) , <br /> 2 .05 .4(2) (a) , 2 .05 .4(2) (c ) <br /> 4 .09 , 4 .13 , and 4 . 14 <br /> CF&I does not intend to fill the portal depression area at the <br /> Maxwell Mine. This feature was established and in use prior to <br /> August 3 , 1977 . This area contains only slightly more than two <br /> acres of the total disturbance area, has slopes at or less than <br /> standards for terrace slopes, will not impound water, and does <br /> not depart from the approximate general nature of the topography <br /> in the immediate area. This feature will not pose a risk to the <br /> environment or public health and safety upon completion of the <br /> reclamation work at the Maxwell Mine. <br /> The second part of the stipulation of this section references <br /> backfilling and grading of other areas at the Maxwell. We <br /> contend no additional backfilling is required and grading will <br /> consist of rounding and blending in of contours . CF&I requests <br /> an on-site meeting with a representative of the division to look <br /> at the need for this requirement if the following and information <br /> does not answer the question adequately. <br /> CF&&I in response to a stipulation in Part 5 of the draft findings <br /> document, agreed to the removal of the sedimentation ponds at the <br /> end of the reclamation effort. The ponds and the appropriate <br /> volume of material to be moved are listed below. <br /> Pond No. Volume <br /> 002 -900 cy <br /> 003 17 ,800 cy <br /> 004 9,500 cy <br /> Total 28 ,200 cy <br /> The material, including topsoil for placement back into the <br /> sediment control pond areas, is adjacent to each pond in the <br /> embankments around them. <br /> The portal itself will be sealed and covered as per the submitted <br /> plan application (Pg. 2 .05-34-36 . The amount of material <br /> required to cover the portal seal will be approximately 600 cubic <br /> yards. This material, except for a minor amount of topsoil; will <br /> come from the final waste disposal area. <br />
