Maxwell Mine <br /> File No. C-013-81 <br /> RESPONSE TO DRAFT FINDINGS DOCUMENT <br /> XVIII Coal Processing Waste and Non-Coal Processing Waste - <br /> Rules 2 .05 .3 (8) , 2 .05 .4( 2) (f) , 4 .10, and 4 .11 <br /> The issues of the first stipulation were discussed with MLR staff <br /> on July 1 , 1982 . It was agreed that- this stipulation will be <br /> removed pending CF&I ' s digging a backhoe pit to demonstrate the <br /> presence of the 3- to 4-foot thick granular material which will <br /> function as a subdrain. CF&I will perform this work as soon as <br /> the appropriate MLRD staff member is available to make this <br /> observation. <br /> CF&I does not find, in the regulations stated, the requirement <br /> for submitting a plan "to inspect and certify refuse piles. " <br /> CF&,I does acknowledge the requirement to inspect sites and <br /> maintain records at the mine. <br /> Inspections and record keeping have been initiated at the Maxwell <br /> Mine . The refuse piles will be inspected quarterly by a <br /> qualified person and the inspections will be continued until the <br /> grading is completed as provided for in Regulation 4 . 10 .2 . <br />
