■ Groundwater Impact: <br /> As per the February 18 , 1993 MLRD/Ciimax meeting , Climax <br /> nas submitteo a. plan to voluntarily implement a <br /> groundwater monitoring program as provided by 6 .2 (3 ) (e) of <br /> the Act . As agreed during:, the August 5 , 1993 MLRD/C ! ima>: <br /> ,:i i scuss i on , a characterization well has been completed , <br /> and is located between the Oxide Por;d (Eagle Park <br /> Reservoir ) water pool and the base of Robinson Dam ;See <br /> Appendix "A " mapo . Mon i for i nu and analysis wi I i be on a <br /> quarterly basis . <br /> ■ Water Rights Issues: <br /> Upon completion of the tailing relocation and dam <br /> modifications , the resulting facility will become the <br /> Eagle Park Reservoir or EPR. A water right fii , ng was <br /> submitted in 1992 to allow for sufficient water storage on <br /> the basis of the existing EPR capacity . Consolidation of <br /> these rights with other existing conditional rights in the <br /> Eagle Valley for other proposed/existing projects is being <br /> negotiated . Climax: is also evaluating the poss ; biiity of <br /> establishing a water company to act as a holding company <br /> for stock associated with water from EPR and ether <br /> projects . Additionally , an agreement with Vail Associates <br /> provides for the purchase of 580, A-F of water from the <br /> Climax Mine rights : ocated at its Arkansas Well . Upon <br /> completion of the EPR project , the 500 A-F of Arkansas <br /> Wei I water w i I I be traded for 500 A-F of EPR water along <br /> with options to purchase additional water from EPR . in <br /> the same agreement , Climax assumes the responsibility for <br /> conversion of the Oxide Pond into the EPR . <br /> ■ Regulatory Issues: <br /> irColorado Department of Health - Water Quality Control <br /> Divisior (WQCD) : <br /> As per discussions on March 17 , 1993 , with the WQCD, a <br /> program was implemented , with WQCD approval , to monitor <br /> and establish water quality background criteria for the <br /> various surface water tributaries relevant to the EPR . <br /> ■ Colorado Cepartment of Health - Air Pollution Control <br /> Division: <br /> After reviewing the project area during a routine site <br /> inspection in August 1993 , the Division representative , <br /> indicated that the Division did not nave any apparent <br /> compliance concerns relative to the project . <br /> - 5 - <br />
