Exhibit E <br />Reclamation Plan <br />LP -21 Mine Permit Amendment <br />M -1977 -305 <br />Cotter Corporation will restore the affected areas in accordance with DOE lease <br />requirements on the LP -21 lease as well as DRMS requirements. The land will be <br />reclaimed for range and wildlife habitat to meet DOE's directives to return the land as <br />closely as possible to the pre- mining land use. <br />Several key points in the DOE lease have an effect on the reclamation plan. They are as <br />follows: <br />1. Because of the possibility that waste dumps may contain what could be in the <br />future a marketable grade of ore, the major portion of the dump cannot be <br />removed from the lease block. This stipulation also limits the extent of grading <br />that can be done; that is, the dump cannot be spread over a large area so as to <br />make the material irretrievable in the future. <br />2. Portals, adits, ventholes, and any other such features of the mine cannot be <br />permanently closed without the approval and consent of the DOE. This would be <br />applicable to the reclamation plan in the event that Cotter would suspend mining <br />when the DOE considered the mine to still hold marketable ore. <br />3. According to the lease, reseeding must be done under the recommendation of the <br />surface managers, the Bureau of Land Management (BLM). Therefore, Cotter is <br />obliged to use the seed mixture recommended by this agency. <br />4. All preexisting structures, including roads, must be left intact and restored to their <br />original state at the cessation of mining. <br />A copy of the DOE lease agreement can be found in Appendix IV - Confidential <br />Documents. <br />This area of Montrose County is zoned agricultural -open. The current land use is <br />predominantly mining and grazing, as is the majority of the land in the near vicinity of <br />the mine site. The proposed post- mining land use for range and wildlife habitat should <br />improve forage and habitat for both wildlife and stock. <br />Surface Disturbances List <br />A. Mine portal <br />B.
