The Division believes that the intended reference may be <br />Rule 4.05.9(7). Please review, and revise as necessary. <br />MCM: Please see revised page 2.05 -18. <br />43. Rule 4.05.9(7)(d) requires that the minimum elevation of the top of the settled <br />embankment be 1.0 foot above the water surface in the pond with the emergency <br />spillway flowing at design depth. Please revise the third paragraph on page <br />2.05 -22 to include the specific language of (7)(d). <br />MCM: Please see revised pages 2.05 -19. <br />-19- October 16, 2012 <br />44. Surface water control systems are depicted on Figure 2.2 -3. The Division <br />has the following comments regarding this map. <br />a. Three cross sections of the pond feature are provided at horizontal scales <br />of 1" = 10' and 1" = 30'. The 1" =200' plan view of the proposed <br />sedimentation pond does not provide sufficient detail for review. Please <br />revise Figure 2.2 -3 to include a detailed plan view of the proposed <br />sedimentation pond at a scale of 1" = 30' or 1" = 10'. <br />MCM: Figure 2.2 -3 will not be resubmitted as there are no changes to the surface <br />facilities proposed. <br />b. On Section A -A', please label the outslope (h:v) of the pond embankment. <br />MCM: Figure 2.2 -3 will not be resubmitted as there are no changes to the surface <br />facilities proposed. <br />45. The requirements of 4.05.9(14), (15) and (17) regarding inspection of the <br />impoundment do not appear to have been addressed in the application. Please <br />provide commitments in the application regarding inspection and certified <br />inspection reports for construction of the sedimentation pond, and <br />quarterly inspections, in accordance with these sections. <br />MCM: Please see revised page 2.05 -21 & 22. <br />46. On revised page 2.05 -22, it is stated in Section 2.05.3(4)(a)(ii)(C) that the <br />sediment in the pond must be removed before the pond is 60% full of sediment. <br />Please revise this sentence to read that the sediment will be removed <br />
