2 <br /> site for the months of August and September. Mr. Levene <br /> outlined the basic contents of the draft agreement being <br /> negotiated between the State and the EPA. Staff said the <br /> agreement should be executed within the next month. <br /> Staff discussed the main activities occurring at the site, <br /> including the Upper Alamosa River Hydrology Project, Phase I <br /> detoxification of the heap leach, the continued coordination <br /> of the technical studies being conducted down-basin and the <br /> Cropsy Waste Pile relocation, which currently involves design <br /> development and review, and finalizing contract agreements <br /> between the State and the EPA. <br /> Staff said contracting discussions continue with the EPA, <br /> involving design parameters, monitoring concerns, possible <br /> hydrological impacts, with regard to the sealing of the <br /> Reynolds Adit and portals. <br /> Staff said the contractual agreement being developed with the <br /> EPA would control the financial participation and outline the <br /> technical involvement/responsibilities of the State with <br /> respect to site reclamation efforts. Staff explained that the <br /> agreement would be drafted between the EPA and DOH and that <br /> DNR would participate through a memorandum of understanding <br /> with DOH. <br /> Mr. Levene referenced the draft agreement/response action <br /> contract and said that discussions with DOH on the contract <br /> are continuing. He presented and discussed a list of key <br /> terms of the proposed contract, specifically relating to cost- <br /> share. <br /> Mr. Levene said the requirement for the provision of a 10t <br /> cost-share on the part of the State would begin after the site <br /> has gained superfund status. The Director, Michael Long, <br /> further explained that if a cost-share agreement is developed <br /> with the EPA to conduct tasks considered remedial, rather than <br /> emergency, the money expended prior to the NPL listing would <br /> be credited toward the entire site after the listing has been <br /> finalized. <br /> Mr. Levene stated that if the site gained NPL status, the <br /> requirement for a 10t State cost-share would be instituted. <br /> He said the EPA would estimate the cost of particular actions, <br /> i.e. , construction costs, and insert 10t of that cost into the <br /> contract as the State' s share. Mr. Levene said that costs <br /> beyond the original estimate would be covered by the EPA and <br /> that in-kind services provided by the State will be allowed to <br /> off-set the State' s share. <br /> Mr. Levene stated that the EPA would certify all of the work <br /> performed at the site and that progress reports would be <br />
