He said the State would make its <br /> payments in two installments; one on September 30, 1994 and <br /> the other on September 30, 1995 . <br /> Mr. Levene said that if the EPA recovers funds from PRPs <br /> (Principal Responsible Parties) , those funds would be <br /> distributed to the parties of the litigation, including the <br /> State. He further stated that the EPA usually does not <br /> recover (additional) funds from PRPs. The Board discussed the <br /> provisions of the contract in detail with Staff and Mr. <br /> Levene. <br /> Staff said the step to be taken after finalization of the <br /> agreement would be the initiation of the scope of work that <br /> had been proposed/agreed upon and included in the agreement. <br /> Staff clarified that the current proposal includes the scope <br /> of work for Phase I of the Cropsy Waste Pile reclamation. <br /> Staff said that plugging of the Reynolds Adit would probably <br /> not be the type of work routinely covered by a reclamation <br /> bond. Staff said the adit plugging would not be undertaken <br /> during the Phase I work. <br /> Staff presented a copy of the design document package for the <br /> mine site and stated that the EPA' s primary contractor for <br /> site remediation would be the Bureau of Reclamation (BOR) . <br /> Staff discussed this with the Board. Staff said the current <br /> estimate of the cost for completion of the Phase I work totals <br /> $6 . 7 million; 10* (for State match) equals $670, 000. <br /> The consensus of the Board was that they wanted to provide the <br /> Division with the discretion to make decisions, regarding the <br /> expenditure of the forfeited reclamation funds, without <br /> bringing each proposal before the Board. Mr. Long, agreed <br /> that it would be beneficial for the Division to have the <br /> authority to make decisions, regarding expenditures of funds <br /> for work on the site that has been included in the approved <br /> reclamation plan. <br /> Staff recommended that the Board delegate the authority to the <br /> Division to complete negotiations to develop the scope of work <br /> proposed to be completed at the site. <br /> The Board delegated the authority to the Division to go <br /> forward and finalize the negotiations on Phase I, including <br /> the expenditure of reclamation funds, so that the project can <br /> proceed as rapidly as circumstances dictate, and requested <br /> that the Division provide the Board with an update, regarding <br /> the status of this matter. <br />
