SHELTON, Director <br /> Richard D.Lamm <br /> Governor <br /> July 19, 1985 _ -- � = • <br /> Mr. Robert Hagen <br /> Office of Surface Mining <br /> Albuquerque Field Office <br /> 219 Central Ave. N.W. <br /> Albuquerque, NM 87102 <br /> RE: Response to Ten Day Notice No. 85-2-244-9 <br /> Dear Mr. Hagen: <br /> In response to the first violation noted in the above referenced TON, the <br /> Division agrees that the BAT ponds located downslope of the No. 1 mine do not <br /> discharge in series. One of the three ponds is not in series. However, the <br /> discharge from all these ponds drains down the haul road and enters the Arctic <br /> Circle ponds which are two ponds in series. <br /> Regarding OSM' s statement that topsoil was not salvaged, the material dredged <br /> from the ponds was placed in the embankments. Due to the boggy nature of the <br /> area, the material would be a homogenous mix. Any topsoil material present is <br /> still available within the embankment if reclamation were required of these <br /> ponds. For the above reasons, the Division does not believe a violation <br /> exists. <br /> Regarding violation no. 2, it is stated that rocks greater than 6 inches are <br /> in the fill of Ponds B and C of the Rock Tunnel Disposal area. The only <br /> information available to the Division at this time on the composition of the <br /> embankment is the embankment compaction testing reports submitted with the <br /> certifications of these ponds. These tests specifically state that the fill <br /> tested meets specifications. Also, during the construction of the Pond B <br /> embankment, it was noted that the material was resampled for a check point <br /> proctor. Results indicated that the material used for Pond B construction was <br /> represented by the original parameters. During the course of testing several <br /> lifts were noted to consist of improper material either in gradation or <br /> moisture content. These lifts were reworked and replaced and retested and met <br /> the specifications. It should also be noted that the testing report shows <br /> that testing was run from the construction of the key cut through completion <br /> of the final grade. The Division finds no problem with the construction or <br /> testing techniques for these ponds. Therefore, the Division does not find <br /> evidence of a violation. <br /> Regarding the third violation of this TON, at this point it would be very <br /> difficult to determine a proper method of routing a 10 year/24 hour <br /> precipitation event through these ponds due to the fact that the exact <br /> 423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
