Crick <br /> Reclamation Specialist <br /> Mined Land Reclamation Division <br /> 215 Centennial Bldg. <br /> 1313 Sherman St. <br /> Denver, CO 80203-2273 <br /> RE: NOV C-89-032; NOV C-89-033 . <br /> Dear Mr. Crick: <br /> Mid-Continent has received two Notices of Violation, namely C-89- <br /> 032 which cites failure to display mine identification sign; and <br /> C-89-033 , which cites failure to salvage topsoil. <br /> Mid-Continent does not believe the facts alleged constitute <br /> violations in the case of either C-89-032 or C-89-033 for the <br /> reasons stated below. We therefore wish to contest the fact of the <br /> violation in each case, and request a conference at a time <br /> convenient to the Division. <br /> Our views concerning these violations are, in part, as follows. <br /> RE: NOV C-89-032 Failure to display mine identification sign at <br /> each entrance to the permit area from public <br /> roads. <br /> CITED <br /> 34-33-122(5) <br /> Each permittee shall conspicuously maintain at <br /> the entrances to his surface coal mining and <br /> reclamation operations a clearly visible sign <br /> which sets forth the name, business address, <br /> and telephone number of the permittee and the <br /> permit number of the surface coal mining and <br /> reclamation operations. <br /> 1 <br />
