4.02. 2 (2) <br /> Signs shall show the name, address, and <br /> telephone number of the person who conducts the <br /> surface coal mining operations and the <br /> identification number of the current permit <br /> authorizing mining activities. <br /> MID-CONTINENT RESPONSE <br /> Mid-Continent maintains a conspicuous sign giving the name, <br /> address, phone number and permit number for the Coal Basin <br /> operations at the junction of the mine road with Highway 133 . <br /> This constitutes the entrance to the mine in that the road leads <br /> only to the mine property, and affords the sole access to the mine <br /> by the public. The present posting of the name, address and phone <br /> number provides adequate notice to the public. Mid-Continent does <br /> maintain a sign giving the name of the mine and indicating the <br /> permit booundary at the actual permit boundary, and repetition of <br /> the address, phone and permit numbers is unnecessary and serves <br /> no useful purpose whatsoever. <br /> There is no possibility of confusion as between the mine identified <br /> at the turn-off from Hwy. 133 and the mine site to which the only <br /> road leading from the turn-off provides sole access. <br /> There is no requirement in the statute or regulations that the <br /> entrance, for the purpose of informing the public, must be <br /> immediately adjacent or attached to the permit boundary. <br /> Mid-Continent believes that the purpose of the cited act and <br /> regulations is to inform the public, and that such a purpose is <br /> best served when the required information is posted in the manner <br /> which will be most conpicuous to the public. <br /> In this case, the present site of the sign giving Mid-Continent's <br /> name, address, phone number and permit number is the most <br /> conspicuous to the public, given its proximity to Redstone, and the <br /> fact that Hwy. 133 is traveled more frequently by the public than <br /> is the road from the highway to the mine. <br /> The NOV states that this sign should, properly, have been sited at: <br /> it the point where the public road <br /> leading west-northwest from Redstone <br /> passes into the permit area, as shown <br /> on Map II-B-1 in the permit <br /> application. " <br /> Mid-Continent then infers that had the present sign been situated <br /> at this point, namely immediately adjacent the permit area, then <br /> 2 <br />
