Notice of Violation C-91-017
Attachment B
Steps Necessary to Abate Violation (Remedial Action)
1 . Repair/reconstruct all road ditch segments as necessary to comply with
approved plan, including installation of riprap checks . As a temporary
measure, 18 inch high berms may be substituted for ditches where solid
bedrock precludes ditch excavation or where natural erosion of upslope
material prevents maintenance of an inside ditch (i .e. Road F, below
Culvert F-1 ) . Berms shall be used to prevent uncontrolled drainage over
the outslope, and shall be tied into dips or water bars as necessary to
direct flow to the inside of the roadway to insure that drainage is
discharged at properly stabilized, designed ditch relief drains or
culvert outfalls. Berms shall not be used where snow removal would push
them over the outslope.
2. Measures shall be taken to insure that drainage from Road C is not
diverted down the pilot road. Water bars shall be installed along the
pilot road at a 100 foot spacing, draining to the outside .
3. Install 1 foot high water bars at a minimum 100 foot spacing within all
road segments where rill erosion on road surface or fill slope was noted
in Attachment A. The water bars shall be constructed to drain toward the
inside ditch .
4. The Mine 2 bench should be regraded or the berm at the terminus of
Road DA should be enlarged to prevent any drainage from the mine bench
from entering the road drainage ditch .
5. Install straw bale barriers or silt fencing in flat areas below the
Road B fill where road drainage has carried sediment offsite. Specific
areas of concern include uncontrolled runoff at Road D, Sta. 0+00 and the
vicinity of Culvert B-2. Also, a series of straw bale check structures
should be staked in place in the flow channel between the B-3 Culvert
outlet and the point where the channel enters the South Fork of Dutch
Creek. A water bar should be constructed in the vicinity of Road D,
Sta. 0+00 to divert road drainage into the ditch rather than over the
fill .
6. Construct water bars to direct drainage off the road to the outside at
100 foot spacing along the light use road which connects the Mine 5
portal area with the mine fan adjacent to the AML project site .
-1-
