r <br /> MID-CONTINENT RESOURCES ASSESSMENT CONFERENCE JULY 17, 1990 <br /> * Today we are holding assessment conferences for notices of violation <br /> C-90-014 and C-90-015 issued to Mid-Continent Resources, Inc. for the Coal <br /> Basin Mines ( File C-81 -017) . <br /> * These violations were issued as a result of a partial inspection of the mine <br /> site by Michael Savage and Harry Ranney of the Division on May 17, 1990. The <br /> violations were issued on-site at the close of the inspection on May 17, 1990 <br /> and were received by Mr. Lew Thompson, Environmental Coordinator for Mid- <br /> Continent. <br /> * Proposed civil penalties for both violations were issued by the Division on <br /> June 7, 1990 and received by Mid- Continent on June 11 , 1990. Requests for <br /> assessment conferences are received by the Division on June 15, 1990. <br /> * Due to the desire to conduct as much business as possible in one day and <br /> personnel scheduling conflicts, MCR waived their 30 day time period for <br /> holding the assessment conference and the conference was scheduled for today. <br /> NOV C-90-014 <br /> * This notice was issued for, " failure to maintain haul road (specifically <br /> culvert D-2) to prevent erosion and siltation. 2. Failure to construct culvert <br /> to avoid plugging or collapse and erosion at inlets and outlets. 3. Failure to <br /> maintain a haul road such that required design standards are met throughout <br /> the entire life of the facility." <br /> * CITATIONS <br /> ASS 34-33-121 (2)(i ) ; CRS 34-33-120(2)(d) ; CRS 34-33-120(2) (j) <br /> REDS 4.03.1 (a) ; 4.03.1 (4)(e)(iii ) ; 4.03.1 (4)(e)(vi ) ; 4.03.1 (1 ) (6) (a) <br /> PERMIT N/A <br /> * The area of concern was road drainage culvert D-2 as depicted on "No. 1 Mine <br /> Haulage Road D Drainage Plan". The concerns with this culvert were two fold. <br /> First, the inlet to the culvert was 1/2 full of sediment, and the sediment <br /> appeared to be inhibiting proper function of the culvert. Second, the outlet <br /> end of the culvert had eroded, resulting in piping beneath the road surface, <br /> with attendant collapse of a portion of the road surface ( approx. 50' long <br /> and 8' wide) and downslope erosion beside the CMP drop structure down the road <br /> outslope. See photos. <br /> * The abatement for this notice was to,"l . Repair or replace the CMP culvert <br /> D-2 so as to prevent further piping and outslope erosion. 2. Repair and <br /> stabilize road outslope at outlet of D-2. " The abatements were to be <br /> completed by June 16, 1990. <br />
