SCHEDULE TO NOTICE OF VIOLATION <br /> As modified 7-21-90 <br /> Notice of Violation No. NOV C-90-014 <br /> NATURE OF VIOLATION: <br /> 1 . Failure to maintain culverts, specifically: failure to maintain haul road culvert <br /> D-2 to prevent erosion and siltation of culvert and failure to maintain a diversion <br /> culvert so as to prevent additional contributions of suspended solids to streamflow <br /> and to runoff outside the permit area. <br /> 2. Failure to control discharge from a diversion. <br /> 3. Failure to maintain a haul road such that required design standards are met <br /> throughout the entire life of the facility. <br /> ACT, REGULATION, OR PERMIT PROVISIONS) VIOLATED: <br /> ACT SECTIONS) CRS 34-33-121 (2)(i ); CRS 34-33-120(2)(d); CRS 34-33-120(2)(j )(v) <br /> REGULATION SECTION(S) 4.03.10 )(a)l 4.03.1 (4)(e)(vi ) ; 4.03.1 (6)(a), 4.05.3(3); <br /> 4.05 .7 <br /> PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br /> 1 . Road drainage culvert D-2 as depicted on "No. 1 Mine Haulage Road D Drainage Plan <br /> ll-B-App. 7 - Att.2 <br /> 2. The CMP diversion, drop structure, and culvert conveying undisturbed drainage <br /> from above Mine #1 , Pad 1 below the pad down the pad outslope, under the road <br /> and down the road outslope. <br /> 3. The conveyance CMP under the haul road from pad 4 to the sediment ponds below <br /> pad 4. <br /> STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br /> Ia. Repair or replace CMP culvert D-2 so as to prevent further piping and outslope <br /> erosion. <br /> b. Repair and stabilize road outslope at outlet of D-2. <br /> 2a. Repair or replace damaged portion of the CMP structure. <br /> b. Stabilize outslope beside CMP down road outslope. <br /> 3. Repair inlet and outlet structures of CMP draining pad 4 to ponds below. <br /> TIME FOR ABATEMENT (NOT MORE THAN 90 DAYS) : <br /> ON OR BEFORE June 16 , 1990 <br /> All abatement steps must be completed by above date. <br /> 9034F/scg <br />
