to all terms and conditions upon cancellation of the suspension. <br /> BE IT FURTHER RESOLVED that Mid-Continent Resources ' Coal Basin <br /> Mines are hereby found to have ceased active mining operations <br /> indefinitely and that Pitkin County Special Use Permit #86-139 is <br /> hereby suspended pending the following actions by the operator: <br /> 1. Water Treatment Plant: The operator' s installation of the <br /> mine-water treatment facility currently partially installed in <br /> the coal preparation plant and operation of that plant as <br /> designed, such installation and operation to be demonstrated <br /> prior to the resumption of coal production. <br /> 2 . Coal Waste Pile: The operator's agreement to notify the County <br /> at least 120 days in advance of any removal of coal spoils from <br /> Coal Basin for any purpose. Such an activity is not currently <br /> permitted by the County and may lead to further amendment of <br /> Permit #86-139 to address mitigation of impacts of that activity. <br /> Such mitigation may include, but not be limited to, testing and <br /> analysis to determine the content and physical composition of the <br /> waste pile. <br /> 3 . Gas and Diesel Tanks: The operator's relocation of the <br /> existing Gas and Diesel fuel tanks and/or pipelines to a location <br /> whereby those pipelines are not suspended over any waterway or <br /> drainage facility and whereby those tanks are adequately <br /> safeguarded against leakage or other hazards. That relocation <br /> will further be subject to the applicable standards of the Fire <br /> Code, the State Oil and Gas Inspector and the State Water Quality <br /> Control Division as their regulations relate to above-ground <br /> 3 <br />
