WHEREAS, the County desires to keep Special Use Permit #86-139 , <br /> and any other relevant State or Federal permits in effect during <br /> the idle period but also desires to make a clear record of its <br /> concerns and expectations of any new owner; <br /> THEREFORE, LET IT BE RESOLVED that the Pitkin County <br /> Commissioners do hereby make the following finding and adopt the <br /> following amendment to Special Use Permit #86-139 regarding the <br /> Mid-Continent Resources Coal Basin Mines: <br /> Finding - That a preponderance of evidence demonstrates that the <br /> following Amendment to Special Use Permit #86-139 is reasonable <br /> and necessary to protect the health and safety of the present and <br /> future inhabitants of Pitkin County. <br /> Amendment - Paragraph 28. Suspension of Permit for Cessation of <br /> Operation - Those aspects of this Permit addressing mining and <br /> its impacts will be considered suspended if active mining <br /> operations at the Coal Basin Mine should cease for an indefinite <br /> period of time without specific arrangements for continuation of <br /> the full Permit having been made beforehand. In the case of <br /> suspension, the County will, at its discretion, establish <br /> preconditions for cancellation of the suspension. Activities <br /> required to comply with the terms of a suspension, those required <br /> to maintain essential facilities during the suspension, and non- <br /> mining activities, will be allowed during the suspension, but <br /> other activities will be considered grounds for revocation of the <br /> Permit. The Permit as it pertains to non-mining activities will <br /> remain in full effect during the suspension and will be subject <br /> 2 <br />
