subject: FY 197 Submission of Civil Penalty Projects: WRCC's
Second submission
On November 20, 1996, WRCC replied to your E-mail message of
10/21/96, by submitting one proposed project to be funded for FY
1997 from the Civil Penalty Account.
That one project, for the State of Colorado, was the Jewell Coal
Strip Mine (proposed for FY 1996 (3/7/96) but not funded] ; we
attached the proposal package submitted for FY '96.
Subsequently, you sent e-mail messages allowing additional time
to submit proposed projects (until 12/16/96) .
At this time, WRCC is forwarding two additional projects for
consideration, both submitted by Colorado. Both of these new
projects are associated with the Coal Basin mine; the mine permit
area included some Federal lands (U.S. Forest Service) , and OSM
was a co-obligee on the deficient reclamation bond. Unabated
public safety and environmental problems reflect badly on OSM's
Federal Lands - Cooperative Agreement program. As noted by
Colorado, the two specific areas proposed for reclamation are
being considered for purchase by the U.S. Forest Service, If the
transaction is completed, recreational use of these areas can be
expected to increase dramatically.
Finally, we note that Colorado personnel (Steve Renner, Dave
. Bucknam) have discussed these proposed projects with Ed Kay,
Deputy Director, within the last year-
Attached please find (1) Colorado's submission for these two new
project proposals, and (2) a table summarizing the three Colorado
projects being submitted by WRCC.
