Section 2.03.5 was revised for both King I and King II volumes to incorporate the recent
NOV. The King II version includes an extraneous paragraph. Please delete the third
paragraph ( "Two violations have been issued...') from the Section 2.03.5 for King II.
Section 2.03. 10 Identification of Other Licenses and Permits
For La Plata County, please add the Class II Special Land Use Permit for which GCCE has
applied (King I and King II). A copy of the permit, when issued, should be inserted with the
county correspondence already found in Appendix 2(1).
The Class II Special Land Use Permit has been added to the Zoning Compliance portion of
Section 2.03.10. Item resolved.
2. Please update the Emission (Construction) Permit numbers and issuance and expiration
dates (King I and King II) to reflect the permits inserted in Appendix 2(2) under MR -34 in
January 2012.
The Emission Permit portion of Section 2.03. 10 was updated as requested. Item resolved.
3. Please update the Wastewater Discharge permit issuance and expiration dates (King I and
King II).
The Wastewater Discharge Permit portion of Section 2.03. 10 was updated as requested.
Item resolved.
Section 2.03.11 Location of Public Office for Filing of Application
1. The address for the La Plata County Clerk and Recorder has changed. It is now 98 Everett
Street, Suite C, Durango, CO 81303. Please revise this section (King I and King II)
accordingly.
The address for the County Clerk's office was updated, as requested; however, it is no
longer located with the La Plata County Courthouse. Please delete "La Plata County
Courthouse "from the address.
Section 2.05.3 Operation Plan — Mine Plan Area and Permit Area
For King I, please revise this section to include a statement explaining that mining at the site
has been completed, and give the approximate date. Please revise the Anticipated
Production paragraph to show historical rather than anticipated rates.
The revisions to 2.05.3 were made, as requested. Item resolved.
2. With respect to the Mine Waste Rock Disposal portion of King I Section 2.05.3, the
Division is aware that GCCE plans to submit a Technical Revision application later this
summer. Please also revise this portion of the permit, as appropriate, to be consistent with
any changes proposed.
The Mine Waste Rock Disposal section was revised to include an updated estimate of the
volume of coal mine waste (refuse) and a reference to the forthcoming TR. Item resolved.
