The Division of Water Resources stated that since there <br />are currently no water administration issues at the mine, the agency has no comments regarding <br />RN -6. The State Historic Preservation Officer determined that a finding of "no historic <br />properties affected" is appropriate, and also addressed the discovery of any previously <br />unidentified archaeological resources. La Plata County's response indicates that they have <br />communicated to GCCE and the BLM that a Class H Special Land Use Permit will be required. <br />These letters are attached, for your records. <br />The Division understands that the public notice for RN -6 was published in the Durango Herald. <br />The Proof of Publication, as required by 2.03.12, has not yet been submitted by GCCE. Please <br />submit proof of publication at,your earliest convenience. <br />The reclamation cost estimate for the King Coal Mine is presently $855,134.05. As part of the <br />RN -6 review, the Division has prepared an updated estimate, which is attached for your <br />reference. The reclamation liability is now estimated to be $835,699.23. This represents a <br />decrease of $19,434.82. Hourly equipment costs increased slightly, resulting in increases to <br />some individual tasks, but decreased revegetation (seed) and structural demolition costs served to <br />offset those increases. <br />Adequacy Review Comments <br />The Division has conducted a review of the permit application package for the King Coal Mine. <br />The package is divided into two volumes: King I and King II. <br />Section 2.03.4 Identification of Interests <br />In King 1, this section was most recently updated with SO -3 in April 2008 and TR -15 in <br />March 2010. The same section in the Ding II volume was updated in January 2012 under <br />MR -35. Please update the King I Identification of Interests to reflect current information. <br />Section 2.03.5 Compliance Information <br />Notice of Violation No. CV- 2012 -003 was issued to GCCE on April 11, 2012. Please <br />update this section to include the latest NOV (King I and King II Volumes). <br />Section 2.03. 10 Identification of Other Licenses and Permits <br />1. For La Plata County, please add the Class II Special Land Use Permit for which GCCE has <br />applied (King I and King I1). A copy of the permit, when issued, should be inserted with the <br />county correspondence already found in Appendix 2(1). <br />
