Tom Bird, GCCE
C- 1981 -035 RN -6 PAR
July 23, 2012
2. Please update the Emission (Construction) Permit numbers and issuance and expiration
dates (King I and King II) to reflect the permits inserted in Appendix 2(2) under MR -34 in
January 2012.
3. Please update the Wastewater Discharge permit issuance and expiration dates (King I and
King II)
Section 2.03.11 Location of Public Office for Filing of Application
1. The address for the La Plata County Clerk and Recorder has changed. It is now 98 Everett
Street, Suite C, Durango, CO 81303. Please revise this section (King I and King 11)
accordingly.
Section 2.05.3 Operation Plan — Mine Plan Area and Permit Area
1. For King I, please revise this section to include a statement explaining that mining at the site
has been completed, and give the approximate date. Please revise the Anticipated
Production paragraph to show historical rather than anticipated rates.
2. With respect to the Mine Waste Rock Disposal portion of King I Section 2.05.3, the
Division is aware that GCCE plans to submit a Technical Revision application later this
summer. Please also revise this portion of the permit, as appropriate, to be consistent with
any changes proposed.
Section 2.05.4 Reclamation Plan
1. Page 2 of this section (King I) addresses the surface facilities that will permanently remain
on site following reclamation. Based on observations made during routine inspections of the
King I surface facilities area, it appears that the shop and upper pump house have been
removed. Presently, the bath house, sales office, substation, lower pump house, 37,000
gallon water tank, laboratory /storage building, and the storage building adjacent to Burnwell
#2 Tipple are still on the site. Please review this section and update as necessary.
2. The Grading and Backfilling and Waste Pile Reclamation subsections on page 4 (King I)
may also require changes with the future TR application. Please ensure that these to
portions of this section are consistent with any changes proposed to the waste bank designs
in Appendix 10.
This concludes the Division's adequacy review of the King Coal Mine permit for Permit
Renewal No. 6 (RN -6). Please contact me with any questions you may have.
Sincerely,
Marcia L. Talvitic, P.E.
Environmental Protection Specialist
Enclosures: Agency Responses (DWR, SHPO, La Plata County), Reclamation Cost Estimate
cc: Sandra Brown, DBMS (w /o Enclosures)
