3.2 Federal Agencies <br />The project is located entirely on private patented claims. Land immediately west of the Atlas Pile <br />is administered by BLM but it is not in the permit area and will not be disturbed. <br />A Spill Prevention, Control and Countermeasure (SPCC) Plan will be prepared in conformance <br />with the U.S. Environmental Protection Agency's (EPA's) regulations for aboveground storage of <br />more than 1,320 gallons of petroleum products. This plan will provide measures for properly <br />storing and handling petroleum products and responding to, and reporting, spills. Normally, the <br />SPCC Plan covers only petroleum based chemicals but the SPCC Plan for this site will have <br />inspection and reporting requirements for the diesel fuel tanks as well as the chemicals stored <br />underground for the mill operation. A Material Containment Plan will also be developed that <br />provides guidance for the storage, use, cleanup, training, and reporting associated with the use of <br />mill chemicals on site. A preliminary Material Containment and SPCC Plan (MCP / SPCC) is <br />presented in Appendix 10. The SPCC Plan also addresses response actions in the event of a site <br />emergency. <br />A 404 dredge and fill permit may be required from the U.S. Army Corp of Engineers because a) the <br />new bridge to the Atlas tailings pile may require COE approval and b) wetlands will be impacted by <br />surface disturbing activities. The 2012 wetland delineation is included in Appendix 9. SMO plans <br />to mitigate wetlands that may be disturbed by purchasing the required amount from a local wetland <br />bank, as required by the COE. <br />3.3 Other State Agencies <br />The Colorado Discharge Permit System (CDPS) permit issued by the Water Quality Control <br />Division (WQCD) will establish the limits for all chemical constituents that must be controlled in <br />the discharge of mine water and runoff water from the surface facilities. This CDPS application has <br />been submitted for review to the WQCD but the discharge permit has not been issued in its final <br />form at this time. The water will be discharged into Sneffels Creek. The discharge will be regulated <br />under Segment 9 of the Uncompaghre River standards, but additional requirements may be <br />stipulated in the permit. The permit will specify sampling points, frequency, and analytes for the <br />mine water. <br />Revenue Mine August 2012 T - <br />
