The following <br /> comments are arranged according to your numbering system on pages 2 through 5. <br /> 1 . The Division believes items 9 and 10 cover the same basic violation, <br /> but it is unclear where these violations were located. <br /> Coal was placed on an undisturbed area south of the road to the No. 2 Mine <br /> coal stockpile, immediately east of the coal stockpile. Also, No. 2 Mine <br /> stockpile coal had fallen into and some was pushed into the undisturbed area <br /> on the south and west sides of the coal stockpile. Some coal was pushed into <br /> a small ephemeral tributary to Dutch Creek. Bear Creek is an undisturbed <br /> drainage. <br /> 2. The Division is unsure what item 15 concerns. Item 17 concerns failure <br /> to maintain the Mine No. 1 coal stockpile drainage ditch. It seems that Item <br /> 15 is the same as 17 and should be further clarified. <br /> 3. Item 31 on page 5 (there are two items numbered 31 ) needs to be <br /> clarified. Trommel screen waste is allowed to be stored on the Mine No. 3 <br /> bench within the sediment control drainage area. <br /> In addition to the violations noted in your inspection report, the Division <br /> also observed the following violations: <br /> 1 . Leakage of diesel fuel northwest of the thermal dryers. <br /> 2. Failure to salvage topsoil during construction of a drainage ditch <br /> behind the warehouse. <br /> 3. Short circuiting of the upper bus garage sediment pond. <br /> 4. Non-coal waste (junk) in coal processing waste east of the road <br /> crossing over the Dutch Creek flume. <br /> 5. Fuel spillage near the Savage Shop. <br /> 6.
