II. Compliance with Colorado Surface Coal Mining Reclamation Act <br /> CRS 1973, as amended 34-33-101, et. sea. , <br /> and the <br /> Rules and Regulations Issued pursuant to the Act <br /> This includes a listing of the particular provisions of the regulatory program which were <br /> examined during the course of this inspection, and identifies enforcement actions taken <br /> during the inspection for failure to comply with the Rules and Regula Lions, the Act and <br /> the permit. <br /> 4.03 Roads • <br /> The roads were in good condition and the road drainage system was function-'ng <br /> properly. The problems noted with drainage on the Mine #1 and Mine #3 roads in the <br /> previous inspection had been corrected. All culverts were open and water was exiting <br /> the roads at design locations. <br /> 4.05 Hydrologic Balance <br /> As noted in the previous inspection, the upper two sediment ponds below the refuse <br /> pile were filled with sediment. The upper pond had been about 7510 cleaned out at- the time <br /> of the inspection and should be completed shortly. Mr. Bowman indicated that the contractor <br /> on the job had been interrupted by a previous commitment, but would complete the clean out <br /> of the upper pond and would clean out the second pond within the next month. <br /> The drainage ditch along coal creek below the thermal dryer was partially filled <br /> with sediment and debris and needs to be cleaned out. It appears that the ditch had been <br /> over topped by snowmelt earlier in the spring, and some rilling was evident on the <br /> embankment above the stream channel . <br /> To the west of the thermal dryer, the berm along Coal Creek had tern breached and material <br /> including snow, coal and assorted debris had been deposited on the inside of the embankment <br /> to the edge of the stream. The incident had evidently occurred during snow remol>al, and <br /> it is possible that the equipment operator was not. aware that material was being pushed <br /> over the berm. The material must be pulled back from the stream and stored or de posed of <br /> properly and the berm must be rebuilt. N.O.V. 82-26 has been issued for failure to protect <br /> the hydrologic balance. <br /> Due to the high elevation and limited space available in the prep plant area, snow removal <br /> is obviously a significant operational problem. "9r. Bowman noted that it is difficult for <br /> the equipment operators to distinguish the location of berms along the streams during the <br /> winter, due to the deep snows. A plan should he developed and measures implemented prior <br /> to next winter to insure that snow and debris which must be cleared from roans and other <br /> areas within the prep plant area is kept within designated areas, and not pu:,-hed cutside <br /> of berms and into the stream channels. <br />
