Compliance with Colorado Surface Coal Ifining Reclamation Act <br /> CRS 2973, as amended 34-33-101, et. sea. , <br /> and the <br /> Rules and Regulations Issued pursuant to the Act <br /> This includes a listing of the particular Provisions of the regulatory program which were <br /> examined during the course of this inspection, and identifies enforcement actions taken <br /> during the inspection for failure to comply with the Rul <br /> the permi t. es and Regulations, the Act and <br /> 4.02 Sins and Markers <br /> All signs and markers were in compliance. Perimeter markers will have to be <br /> Put up following approval of the permit application. <br /> 4.03 Roads <br /> 1) The culvert east of the warehouse leading to pond 010 was plugged. Mr. Bowman <br /> stated that a new culvert is to be put in there. <br /> 2) The culvert near the mine #2 bin was filled with sediment. <br /> 3) The culvert on the mine #5 lower bench was overtopping and must be cleaned. <br /> 4) The first haul road culvert above the mine #2 coal stockpile must be cleaned. <br /> 4.05 Hydrologic Balance <br /> 1) Upon arrival at the Coal Basin mines, the water flowing in Dutch Creek was <br /> sufficiently sediment-free to see the bottom in the Dutch Creek Flume. At approximately <br /> 10:30 - 11:00, it was observed that the water in Dutch Creek was very turbid. Upon walking <br /> up the canyon, it was observed that coal waste was flowing over the top of the snow. Upon <br /> further investigation, it was determined that the source of the material was the outslope <br /> of the mine #1 bench. Relatively clean water was flowing from under the snow and a <br /> saturated mud was flowing over the top. <br /> Evidently, snow had been pushed over the edge of the mine #1 bench along with <br /> some coal fines and possibly some coal waste. The outslope is on a southern exposure. When <br /> the snow melted, it created a mudflow. <br /> Notice of Violation No. 82-28 was written for failure to minimize disturbance <br /> to the prevailing hydrologic balance. Since improper snow removal was the source of <br /> the problem, the operator will have to develop a snow removal plan to avoid similar problems <br /> in the future. <br /> 2) Coal processing waste which had dropped from the conveyor and snow had been pushed <br /> along the edge of the bridge over the Dutch Creek Flume. It was evident that some of the <br /> coal processing waste was entering Dutch Creek. Mr. Bowman contacted maintenance personnel <br /> to clean up the waste immediately. <br />
