Compliance with Colorado Surface Coal Mining Reclamation Act <br /> CRS 1973, as amended 34-33-101, et. sue. , <br /> and the <br /> Rules and Regulations Issued Pursuant to the Act <br /> This includes a listing of the particular provisions of the regulatory program which were <br /> examined during the course of this inspection, and identifies enforcement actions taken <br /> during the inspection for failure to comply with the Rules and Regulations, the Act and <br /> the permit. <br /> 4.02 Signs and Markers <br /> All required signs are present with the exception of perimeter markers which must <br /> be put up this summer. <br /> 4.03 Roads <br /> All roads checked were well maintained and ditches were actively being cleaned. <br /> Snow still remains in some areas, so those ditches cannot be cleaned yet. <br /> 4.05 Hydrologic Balance <br /> 1. New risers were being put on 5 mine pond and the third pond below the refuse pile. <br /> 2. The berm along Coal Creek near the MK garage must be rebuilt. <br /> 3. The washplant-refuse pile perimeter ditch needs to be cleaned in several places. <br /> There appears to be little chance that the ditch will breach so cleaning should <br /> be done following peak runoff. <br /> 4. Undisturbed drainage was entering the wash plant area on the west side. The <br /> operator should divert this water directly into Coal Creek. <br /> 5. The first pond below the refuse pile was completely full of sediment and the <br /> second pond was approximately half-full. These ponds must be cleaned out as <br /> soon as possible. <br /> 4.15 Revegetation <br /> Seedlings were observed to be emerging on the embankments of the sediment ponds <br /> below the refuse pile. Revegetation success will be evaluated this summer. <br />
