II. Compliance with Colorado Surface Coal :dining Reclamation Act <br /> CRS 1973, as amended 34-33-101, _t, sec. , <br /> and the <br /> Rules and Regulations Issued Pursuant to the Act <br /> This includes a listing of the particular provisions of the regulatory program which were <br /> examined during the course of t.`�is inspection, and identifies enforcement actions taken <br /> during the inspection for failure to comply with the Rules and Regulations, the Act and <br /> the permi t. <br /> 4.02 Signs and Markers <br /> The mine identification sign was up at the entrance to the mine. All topsoil <br /> markers were up, with the exception of a marker on the topsoil stockpile at the outslope <br /> of the mine #1 sediment pond. Perimeter markers are to be put up following approval of <br /> the permanent program permit application. <br /> 4.03 Roads <br /> All the roads appeared to be well-maintained, with the exception of the mine #4 <br /> haul road. This road is not constantly maintained, since mine #4 is shut down. Although <br /> there has been no noticeable maintenance on the road, there do not appear to be any <br /> environmental problems. <br /> The road recently constructed to access a new mine #2 escapeway was in good shape. <br /> The road was left in a very rough condition with water bars placed at appropriate intervals. <br /> There appeared to be no environmental problems with the road. The road will be seeded <br /> this fall, according to Mr. Bowman. <br /> Drainage ditches along most of the roads were in excellent shape. All road drainages <br /> should function properly. There was no evidence that any of the ditches failed during <br /> recent heavy rains. The ditches were being regraded during the inspection. <br /> All the drainage culverts were recently cleaned out. Several of the culverts along #5 <br /> mine road had deformed ends where a backhoe had hit them. These should be repaired. <br /> The Coal Creek culvert by mine #5 had been completely filled with sediment during a <br /> recent rain. The area behind the road had been filled to a depth of approximately 7 feet. <br /> This was all cleaned out prior to the inspection. <br /> 4.04 Support Facilities <br /> No problems were noted with the support facilities at the mine. A new truck loading <br /> bin was being constructed at the stockpile for coal from mine #2. <br /> 4.05 Hydrologic Balance <br /> out. The upper artic circle pond was partially filled with sediment, which must be cleaned <br /> Some small gullies were observed near the powder magazine above the rock tunnel <br /> area. This area must be regraded to remove the gullies. <br /> The drainage at the turnoff to the #4 mine road must be repaired. This area has <br /> been a continual problem and possibly should be redesigned. <br />
