hour. CONTRACTOR must provide a wind speed measurement device, and maintain it in an <br />operating condition throughout the duration of the Project. <br />CONTRACTOR shall keep thorough and accurate records throughout the duration of the <br />Project. Records shall indicate material applied, dilution factor, application rate per acre, <br />ambient air temperature (at 9:00 a.m., noon and 3:00 p.m.) and wind speed (at 9:00 a.m., noon, <br />3:00 and 5:00 p.m.). <br />CONTRACTOR shall conform to all applicable environmental and safety standards given <br />application methods, duration and products. CONTRACTOR shall not clean and dispose of <br />unused or remnant materials in a manner which is deemed to be deleterious to environmental <br />resources of the area. Failure to conform to these specifications shall result in immediate <br />suspension of contract. <br />Because the infested areas are adjacent to public use areas, CONTRACTOR shall post three <br />(3) signs at the Project Area in locations specified by Project Manager. The signs will be posted <br />five (5) days in advance of each treatment. CONTRACTOR will remove the signs following <br />completion of the Project. The signs shall include the following information: <br />Notice of intent to apply weed control chemicals; <br />Warning not to enter area the day of application; <br />Estimated date of application; <br />Common name of material to be applied; <br />Contractor name and phone number; <br />"Project administered by Colorado Division of Minerals and Geology. <br />For more information call (970) 241 -0336 or (303) 866 - 3567." <br />Additionally, small plastic warning signs shall be posted at three hundred feet (300') intervals <br />along the roads which traverse the Project Area. These signs shall be posted at the time of <br />application, and shall be removed by CONTRACTOR no sooner than 24 hours following <br />application. <br />Other CONTRACTORS may be working in and near the Project Area during performance of this <br />Project. CONTRACTOR is cautioned to be aware of heavy equipment, as well as hand <br />laborers, and is advised to coordinate activities with others to the extent that becomes <br />necessary. PROJECT MANAGER will assist in this regard. <br />Measurement and Payment <br />Measurement for payment will include monitoring of random sample plots for target species kill <br />rates following each application. The same sample plots will also be monitored for survival of <br />non - target species. Payment will be adjusted according to the following tables, should <br />monitoring indicate that the specifications were not met. CONTRACTOR will be notified of the <br />sampling date, and is encouraged to attend. Should a disagreement occur regarding the <br />outcome of the sampling, the disputed sample plots will be re- monitored. Results of the second <br />sampling after each application, regardless of the outcome, shall be binding on both parties. <br />CONTRACTOR will assume the cost for the second sampling. <br />5 <br />
